CONDICIONES GENERALES DE CONTRATACIÓN DEL ARRENDAMIENTO DE VEHÍCULOS
Las presentes Condiciones Generales regulan la relación contractual entre Fauria Grup SHS S.L, (“el arrendador”) y el cliente (“el arrendatario”), en virtud de las cuales el primero cede al segundo el uso de un vehículo por el plazo, precio y demás condiciones que se establecen en el contrato de alquiler.
- REGULACIÓN JURÍDICA APLICABLE
1.Las presentes Condiciones Generales de Contratación se encuentran sujetas a lo dispuesto por el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el Texto Refundido de la Ley general para la defensa de los consumidores y usuarios y otras leyes complementarias, modificada por la Ley 3/2014, de 27 de marzo; a la Ley 44/2006, de 29 de diciembre, de mejora de la protección de los consumidores y usuarios, a la normativa autonómica vigente en el lugar de prestación del servicio, así como a cualquier otra normativa que sustituya, complemente o modifique lo anterior, en lo que pueda resultar de aplicación.
- El arrendatario está obligado al cumplimiento de las Condiciones Generales de Alquiler del país de prestación del servicio.
- UTILIZACIÓN DEL VEHÍCULO
- El arrendatario se compromete a utilizar y conducir el vehículo cumpliendo con las normas del Código de Circulación vigentes en el lugar y en el momento de prestación del servicio y conforme a las especificaciones de uso del tipo de vehículo arrendado.
- Es de obligado cumplimiento que el arrendatario lleve siempre consigo su ejemplar del contrato de alquiler vigente durante la duración del mismo.
3.- En caso de utilización del vehículo para el transporte de menores de edad de estatura igual o inferior a 135 centímetros, el arrendatario deberá proveerse de sistemas de retención infantil adePcuados a cada grupo de edad y situarlos en el vehículo de conformidad con la normativa de tráfico vigente. El arrendatario también deberá comprobar la adecuación, uso y colocación en el vehículo de los sistemas de retención infantil. El arrendador no asume responsabilidad por la falta de uso, instalación, comprobación, uso incorrecto del dispositivo de retención obligatorio.
- El vehículo solamente podrá ser utilizado en carreteras públicas.
Queda expresamente prohibido:
- a) Conducir el vehículo en vías no autorizadas o no pavimentadas, o cuyo estado pudiera suponer un riesgo para la seguridad e integridad del vehículo o un riesgo de daños para el mismo;
- b) Participar con el vehículo en carreras, pruebas de velocidad y/o resistencia, concursos o desafíos de cualquier naturaleza;
- c) Utilizar el vehículo para la realización de prácticas de conducción;
- d) Utilizar el vehículo para pruebas de resistencia de materiales, accesorios o productos para automóviles;
- e) Utilizar el vehículo en caso de riesgo de daños para el mismo, en especial utilizar el vehículo tras haberse iluminado los testigos luminosos del cuadro de instrumentos;
- f) Transportar personas mediante contraprestación;
- g) Cometer actos delictivos con el vehículo, incluso si dicho acto solo tiene la consideración de delictivo en el lugar de comisión;
- h) Conducir el vehículo con disminución de condiciones físicas, motivadas por alcohol, drogas, fatiga o enfermedad;
- i) Utilizar el vehículo para empujar o remolcar otros vehículos o cualquier otro objeto;
- j) Transportar en el vehículo sustancias tóxicas, inflamables y en general peligrosas y/o que infrinjan las disposiciones legales vigentes;
- k) Transportar el vehículo a bordo de cualquier tipo de barco, tren, camión o avión, salvo autorización expresa por escrito por parte del arrendador;
- l) Circular en el interior de recintos de puertos, aeropuertos, aeródromos y/o análogos de carácter no accesible al tráfico público, así como en recintos o instalaciones de refinerías y compañías petrolíferas, salvo autorización expresa por escrito por parte del arrendador.
- El arrendatario deberá cuidar que la carga del vehículo esté correctamente distribuida y colocada de forma segura y respetando siempre los límites de peso, cantidad y/o volumen autorizado e indicado en el Permiso de Circulación y/o la Ficha de Inspección Técnica del Vehículo. Igualmente, el arrendatario se responsabiliza de que el número de ocupantes del vehículo no sea superior al autorizado e indicado en el Permiso de Circulación y/o la Ficha de Inspección Técnica del Vehículo.
- Queda prohibido al arrendatario ceder, subarrendar, alquilar, hipotecar, pignorar, vender, gravar o de cualquier manera dar en garantía tanto el vehículo como el contrato de alquiler, las llaves del mismo, la documentación, el equipamiento, las herramientas y/o accesorios del mismo y/o cualquier otra parte o pieza del mismo; o tratar lo anterior de manera que cause perjuicio al arrendador.
- A continuación, encontrará información relativa a los países a los que no está permitido desplazar el vehículo arrendado, así como los países para los que no se alquilan determinados modelos de vehículos. La elección de una categoría o marca de vehículo puede restringir la entrada en determinados países. Al objeto de describir estas restricciones de entrada, los países se dividen en tres zonas.
Zona 1: España
Zona 2: Andorra, Francia
Zona 3: Todos los países no incluidos en la zona 1 o zona 2.
Los vehículos considerados Premium Cars no podrán salir de España salvo autorización expresa por escrita por parte del arrendador.
Los vehículos de todas las demás marcas podrán entrar solamente en las zonas 1 y 2.
Por lo general, no se permite la entrada en los países de la zona 3.
El grupo al que pertenece un vehículo se puede consultar en cualquier momento en línea www.rentacarcostabrava.com, así como por teléfono o en cualquier oficina de Rent a Car Costa Brava.
En los arrendamientos efectuados en España, se prohíbe de forma expresa el desplazamiento del vehículo de la península a cualquier isla y viceversa y/o entre islas, así como a Ceuta y Melilla, todo ello salvo autorización expresa por escrito por parte del arrendador.
El contrato de alquiler también contiene esta información.
Es obligación del arrendatario comprobar las regulaciones específicas de circulación de los países a los que tenga previsto desplazarse y asumir las responsabilidades derivadas del no cumplimento de las mismas. El arrendatario deberá comprobar si en los países a los que tenga previsto desplazarse es obligatorio el uso de determinados neumáticos, o el pago de tasas de circulación o peajes específicos por la conducción por determinadas vías especiales y satisfacer dichas tasas o peajes.
- Viajes transfronterizos: el Cliente está autorizado a conducir el vehículo alquilado dentro de España. En el apartado B.7 de las presentes condiciones generales se establecen los países a los que no es posible desplazar el vehículo. El desplazamiento del vehículo fuera de España tiene carácter de viaje transfronterizo y requiere el pago de una tarifa adicional. El importe de dicha tarifa puede consultarse en el documento anexo a estas condiciones denominadas Relación de cargos adicionales. El incumplimiento de la prohibición de desplazar el vehículo a determinados países, por culpa o negligencia, está sujeto a una penalización de 150 €, que tiene carácter de pena contractual. Fauria Grup SHS S.L también podría reclamar una compensación por daños y perjuicios superior al importe anterior acreditando unos mayores daños y perjuicios. En tales casos, la reclamación de la pena contractual quedará compensada con cualquier reclamación de indemnización adicional por daños y perjuicios que derive de ese mismo incumplimiento de las obligaciones.
- En el momento de formalización del contrato de alquiler, el arrendatario y cualquier otra persona designada en el contrato de arrendamiento como conductor deberán estar presentes y presentar permisos de conducción válidos y vigentes en el país del alquiler, así como sus correspondientes documentos de identificación personal vigentes. El arrendador se reserva la facultad expresa de denegar el alquiler del vehículo en el supuesto de que el arrendatario o cualquier otra persona designada en el contrato de arrendamiento como conductor no acreditaran en debida forma su identidad o ser titular de un permiso de conducción válido y vigente en el momento de formalizar el contrato de alquiler. No se aceptarán permisos de conducir en formato digital o electrónico excepto si la normativa de aplicación lo permitiera expresamente.
El vehículo solamente podrá ser conducido por el arrendatario, así como por aquellas personas designadas en el contrato de arrendamiento como conductor, siempre que sean mayores de 21 y 25 años respectivamente en función de la categoría del vehículo a arrendar y cuyos permisos de conducción tengan la antigüedad exigida dependiendo del grupo de vehículo a arrendar según se especifica en el documento de relación de Cargos Adicionales. Respecto a los conductores menores de 23 años de edad se aplicarán cargos específicos, cuyos importes se encuentran disponibles en el documento de Relación de Cargos Adicionales.
Se consideran permisos de conducción válidos en España los siguientes:
- a) Los expedidos de conformidad con la legislación española en vigor;
- b) Los expedidos por los estados miembros de la Unión Europea con arreglo a la normativa comunitaria;
- c) Los expedidos por otros países que fueran reconocidos como válidos a efectos de permitir la conducción en España según la normativa de la Dirección General de Tráfico española.
- d) Permiso internacional válido, que se aportará junto con el permiso nacional válido del país que correspondiera a efectos de permitir la conducción en España según la normativa de la Dirección General de Tráfico española.
- Sin perjuicio de la responsabilidad del arrendatario frente a terceros, de incumplirse alguna de las obligaciones previstas en esta estipulación B o de concurrir alguna de las circunstancias previstas en las estipulaciones B.4, B.5, B.6, B.7, B.8 y B.9, podrá el arrendador dar por resuelto con efectos inmediatos el contrato, así como reclamar la indemnización de los daños y perjuicios, inclusive el lucro cesante, que el incumplimiento de que se trate le haya ocasionado.
Del mismo modo, ante incumplimientos de obligaciones esenciales por parte del arrendador, podrá el arrendatario resolver anticipadamente el contrato de alquiler antes de que transcurra el plazo inicialmente acordado, de conformidad con lo dispuesto en la legalidad vigente y en estas condiciones generales.
- ESTADO DEL VEHÍCULO
- El arrendador entregará y el arrendatario recibirá el vehículo descrito en el contrato en correcto estado de funcionamiento, mantenimiento y chapa, sin deficiencias, salvedad hecha de las observaciones que en su caso se efectúen al recibir el vehículo en el propio contrato de alquiler. En el caso de encontrarse en el vehículo arrendado alguna deficiencia no recogida en el propio contrato de alquiler, será obligación del arrendatario comunicarlo a la oficina del arrendador en la cual se ha realizado el contrato de alquiler y se hace entrega del vehículo, antes de mover el vehículo de la plaza de aparcamiento en la cual se encuentra aparcado el vehículo especificado en el contrato, al objeto de que se incorporen dichos datos al contrato de alquiler que se entregará de nuevo al arrendatario.
- El arrendatario recibirá el vehículo descrito en el contrato con la documentación completa, así como con la llave del vehículo, herramientas y accesorios, en especial chalecos reflectantes y triángulos de señalización, lo cual deberá comprobar el arrendatario en el momento de entrega del vehículo al inicio del arrendamiento, notificando cualquier deficiencia en la oficina en la que alquiló el vehículo. El arrendatario se compromete a utilizar los accesorios con diligencia y a devolverlos en el mismo estado en que se le entregaron. En el caso de no devolución de los accesorios a la finalización del contrato de alquiler, el arrendatario deberá abonar al arrendador el valor de los accesorios no entregados, en base al cargo en concepto de indemnización de los mismos reflejado en el documento de Relación de Cargos Adicionales. Es responsabilidad del arrendatario en todo momento cerrar el vehículo de forma correcta al salir del mismo.
- En caso de que durante el alquiler del vehículo se iluminara en el cuadro de instrumentos cualquiera de los testigos luminosos que detectaran una anomalía de funcionamiento del vehículo que afectara la seguridad e integridad del mismo o cuando percibiera signos externos que indiquen avería o mal funcionamiento del mismo, el arrendatario deberá detener el vehículo lo antes posible y contactar con el arrendador o con la compañía de asistencia en carretera concertada por el arrendador. Utilizar el vehículo en caso de riesgo está prohibido. Solo se aceptarán cargos de compañías de asistencia en carretera no concertadas por el arrendador en los casos de urgencia, debiendo provenir de talleres oficiales de la marca del vehículo y previa autorización expresa por escrito por parte del arrendador. Igualmente, manipular el cuenta-kilómetros del vehículo está totalmente prohibido, debiendo el arrendatario comunicar inmediatamente al arrendador cualquier avería en el mismo.
En función de las coberturas contratadas por el arrendatario en la estipulación G de estas Condiciones Generales, se podrá aplicar un cargo por asistencia en carretera, según se especifica en el documento de Relación de Cargos Adicionales. Únicamente en supuestos de fallo mecánico no imputable a un actuar negligente por parte del arrendatario, con independencia de la contratación o no de coberturas según la estipulación G de estas Condiciones Generales, el arrendatario no asumirá cargo alguno por el servicio de asistencia en carretera.
Siempre y en todo caso, el arrendatario deberá responder si ha hecho un uso prohibido del vehículo, según consta en la estipulación B.4 de estas Condiciones Generales, así como en caso de negligencia.
- El arrendatario deberá atender a los avisos de niveles de líquido y aceite, así como revisar regularmente los mismos y, en general, permitir la realización de las inspecciones de seguridad o revisiones que sean procedentes y conformes a las especificaciones de uso del tipo de vehículo. Estas revisiones deberán realizarse por los talleres autorizados por el arrendador, de lo contrario el arrendatario responderá de cualquier perjuicio que se derive de la incorrecta reposición de los niveles de líquido del motor del vehículo arrendado.
El arrendatario se compromete a tratar y conservar el vehículo con el cuidado y con la diligencia, a respetar todas las normas y reglas técnicas aplicables y a comprobar periódicamente si el vehículo se encuentra en buen estado de funcionamiento, así como a cerrarlo de forma correcta. Queda prohibido fumar en el vehículo de alquiler.
- En los arrendamientos de vehículos provistos de un depósito AdBlue ®, deberá el arrendatario verificar que el tanque esté siempre suficientemente lleno, respondiendo de los perjuicios que se ocasionen por el incumplimiento de esta obligación. El arrendatario deberá avisar inmediatamente al arrendador en caso de encenderse el piloto luminoso del cuadro de instrumentos que indique la necesidad de llenar el depósito de AdBlue, debiendo seguir las instrucciones que le sean dadas en ese momento por el arrendador. En el caso de que el arrendatario no siguiera las instrucciones impartidas por el arrendador y a consecuencia de ello se originasen daños en el vehículo, el arrendatario será responsable de los mismos.
- Los vehículos con motor de combustión (incluidos los vehículos híbridos) se entregarán al arrendatario con el depósito de combustible en el nivel indicado en el contrato el mismo día que recoge el vehículo, obligándose este último a devolverlo en el mismo estado en que lo recibió. En caso de que el arrendatario no devuelva el vehículo con el tanque de combustible acordado en el contrato inicial, se le aplicará un cargo adicional que comprende tanto el coste del combustible como el cargo por la gestión de repostaje, reflejado en el documento de Relación de Cargos Adicionales. Este cargo podrá hacerse efectivo mediante cargo al Depósito de garantía o al método de pago válido con el que se ha garantizado el pago del arrendamiento. No se devolverá cantidad alguna por el posible combustible que pueda quedar en el tanque.
El arrendatario deberá repostar el vehículo con el tipo de combustible adecuado para el mismo, de lo contrario el arrendatario será responsable de los gastos ocasionados por el traslado y/o la reparación de los daños producidos en el vehículo a raíz de ello. Asimismo, en dicho caso, el arrendatario deberá abonar al arrendador un cargo en concepto de lucro cesante por los días de inmovilización del vehículo, que será establecido tomando como referencia el certificado sobre el lucro cesante por paralización de vehículo emitido por la Federación Nacional Empresarial de Vehículos de Alquiler con y sin Conductor (FENEVAL) que determine la cuantía diaria de la paralización.
- El arrendatario recibe el vehículo con todos sus neumáticos en buen estado y sin pinchazos, junto a un neumático de repuesto (o en su defecto un kit de reparación) En vehículos equipados con el sistema de neumáticos run flat (tipología de neumáticos que permite que rueden sin aire durante un número determinado de kilómetros) el vehículo podrá recibirse sin neumático de repuesto o kit de reparación. En caso de deterioro y/o pérdida de cualquiera de los neumáticos (por causa que no sea desgaste normal, deficiente montaje o defecto de fabricación) el arrendatario se compromete a informar el arrendador. Las reparaciones y/o sustituciones de neumáticos deberán realizarse por los talleres autorizados por el arrendador, de lo contrario el arrendatario responderá de cualquier perjuicio que se derive de la incorrecta reposición de los mismos. .
- Queda prohibido al arrendatario variar cualquier característica técnica del vehículo, así como realizar cualquier modificación de su aspecto exterior y/o interior (salvo autorización expresa escrita por parte del arrendador). En caso de infracción de esta estipulación, el arrendatario deberá abonar al arrendador los costes, debidamente justificados, de reacondicionamiento del vehículo a su estado original y abonar al arrendador un cargo en concepto de indemnización por lucro cesante por los días de inmovilización del vehículo, que será establecido tomando como referencia el certificado sobre el lucro cesante por paralización de vehículo emitido por FENEVAL (Federación Nacional Empresarial de Vehículos de Alquiler con y sin Conductor) que determina la cuantía diaria de la paralización..
Queda prohibido al arrendatario reparar por sí mismo o por terceros el vehículo, salvo autorización expresa por parte del arrendador.
- Previa autorización por escrito por el arrendador, en los casos en los que, por el peso neto del vehículo y la posibilidad de acoplar un remolque al mismo, debiera pagarse un suplemento del impuesto de circulación, deberá el arrendatario realizar los trámites correspondientes y satisfacer el mismo, con completa indemnidad del arrendador por cualquier tasa, impuesto, recargo, sanción o coste que se le impusiera por incumplir la normativa aplicable. El vehículo arrendado deberá devolverse al arrendador en las mismas condiciones en que se recibió.
- RESERVAS
- Las reservas de vehículos se refieren a categorías de vehículos. La reserva en una categoría no confiere el derecho al arrendatario a la asignación de un modelo concreto dentro de la misma.
- El arrendador mantendrá la reserva del vehículo hasta sesenta minutos después de la hora convenida, no estando obligado a prestar el servicio en las condiciones pactadas transcurrido dicho plazo.
Las cancelaciones se deberán efectuar con una antelación mínima de 24 horas respecto del inicio del alquiler.
- En relación con las reservas con tarifa prepago será aplicable lo siguiente
- Hasta una hora antes del comienzo del alquiler se podrán realizar modificaciones, en cuyo caso se aplicará al arrendatario un cargo por modificación según se especifica en el documento de Relación de Cargos Adicionales, además de la diferencia entre la tarifa seleccionada inicialmente y la tarifa a la que se ha cambiado.
- El precio a aplicar tras la modificación de la reserva será el de la tarifa vigente en el momento de la realización del cambio. El arrendador no realizará ningún reembolso del anticipo del precio de alquiler ya abonado/pagado por adelantado, ni de la eventual diferencia de tarifa en el supuesto de surgir una diferencia de precio tras la modificación realizada.
- Se puede cancelar la reserva prepago previamente al inicio del alquiler con una antelación mínima de 24 horas. En caso de cancelación, el arrendador reembolsará al arrendatario el anticipo del precio de alquiler ya abonado o pagado por adelantado, reteniendo el cargo por cancelación que asciende al precio de los tres primeros días de alquiler (precio calculado conforme a lo expuesto en la estipulación E de estas Condiciones Generales, incluyendo equipamiento adicional y servicios complementarios). En caso de que la duración de la reserva sea inferior a tres días, no se devolverá cantidad alguna al no existir derecho de desistimiento respecto de la actividad de alquiler de vehículos.
- Las cancelaciones se podrán realizar online (www.rentacarcostabrava.com/) o de forma escrita por correo postal (mediante carta a Fauria Grup SHS S.L. Avinguda Vidreres nº 3. Lloret de Mar (17310) Girona.
- CARGOS POR ALQUILER / VENCIMIENTOS / DEPÓSITO DE GARANTÍA / FORMA DE PAGO
- El arrendatario se compromete a pagar al arrendador:
1.1 Los cargos por alquiler reseñados en el contrato de alquiler correspondientes a duración (cargo mínimo de alquiler de 24 horas), coberturas, limitaciones de responsabilidad, equipamiento adicional y servicios complementarios, según las condiciones estipuladas, así como los impuestos y tasas aplicables.
Éstos se facturarán en base a las tarifas vigentes en el momento de realizar la reserva. En caso de no haberse reservado con anterioridad y/o salvo que se haya convenido una bonificación o precio especial, se aplicarán los cargos por alquiler relacionados en las tarifas vigentes en el momento de realizar el contrato de alquiler.
1.2. Los cargos derivados de la no devolución del vehículo alquilado en el mismo estado correcto de funcionamiento, mantenimiento y chapa como lo recibió en el momento del alquiler. El arrendatario es responsable frente al arrendador de cualquier daño ocurrido en el vehículo durante el periodo de alquiler, del robo parcial o total del mismo y de los perjuicios derivados de incumplimientos contractuales, salvo las limitaciones de responsabilidades y coberturas opcionales que aquel haya contratado (ver estipulación G.2.1 de estas Condiciones Generales), además de lo que resulte de aplicar las disposiciones legales vigentes en lo no regulado en estas Condiciones Generales.
De contratarse las limitaciones de responsabilidad recogidas en la estipulación G.2.1 de estas Condiciones Generales y producirse un siniestro, dichas limitaciones no serán de aplicación en los supuestos que se enumeran a continuación, respondiendo en estos supuestos el arrendatario íntegramente de los daños y perjuicios ocasionados:
- Daños y perjuicios ocasionados por él mismo o por aquellas personas por las que deba responder, cuando medie dolo o negligencia grave;
- En los casos en que el arrendatario no entregue el parte descriptivo de accidente y/o parte de declaración amistosa o lo haga de forma tardía o incompleta, o consigne hechos y datos falsos en los mismos;
- En caso de omisión del deber de socorro o por la omisión de la obligación de recabar la presencia policial prevista en el clausulado H, salvo que dichos daños se hubiesen ocasionado sin mediar dolo o negligencia grave del arrendatario;
- En el caso de que el causante del daño sea un conductor no autorizado;
- En el caso de contravenirse las prohibiciones de las estipulaciones B.4,B.5, B.6, B.7 y B.8 de estas condiciones Generales.
Los cargos por reparación de los que deba responder el arrendatario vendrán calculados por el perito independiente y oficial a tal efecto seleccionado por el arrendador o por otro perito elegido de común acuerdo por las partes. El importe así determinado – en su caso, el importe de la franquicia – será reclamado al arrendatario junto con el cargo administrativo por gestión de expedientes de daños y el importe de la foto-peritación, cuyas cuantías se reflejan en el documento de Relación de Cargos Adicionales. El arrendatario tiene derecho a recibir una copia de la peritación. En el caso de que el coste no se pueda determinar de este modo, vendrá fijado por el presupuesto del taller de reparación. El importe de la indemnización a cargo del arrendatario por siniestro total será el valor de mercado previo a la pericial del vehículo al producirse el suceso. El arrendador está facultado para reclamar el daño emergente (inclusive grúas, peritajes, costes legales, etc.) y el lucro cesante por la falta de disponibilidad del vehículo.
1.3. Los cargos por contratación de equipamiento adicional después de haberse formalizado el contrato de alquiler y solicitados durante la duración del mismo. Éstos se facturarán en base al documento de Relación de Cargos Adicionales en el momento de contratación de los mismos y deberán aparecer en el nuevo contrato de alquiler firmado por el arrendatario.
Los cargos por contratación de servicios o coberturas opcionales complementarios después de haberse formalizado el contrato de alquiler y solicitados durante la duración del mismo. Éstos se facturarán en base al precio vigente en el momento de su contratación y deberán aparecer en el nuevo contrato de alquiler firmado por el arrendatario. Una vez entregadas las llaves del vehículo, únicamente pueden añadirse coberturas opcionales complementarias dentro de los 15 minutos siguientes a la firma del contrato de arrendamiento inicial.
1.4. El combustible no repostado en el vehículo arrendado en el momento de devolución del mismo, así como los costes de servicio de repostaje de dicho combustible, según lo estipulado en la estipulación C.6 de estas Condiciones Generales. El cargo del combustible se facturará en base al precio actual de mercado y el cargo por servicio de repostaje en base al importe reflejado en el documento de Relación de Cargos Adicionales.
1.5. Los cargos por traslado y/o reparación de los daños del vehículo motivados por uso de combustible inadecuado en un repostaje incorrecto, según lo estipulado en la estipulación C.6 de estas Condiciones Generales.
1.6. El kilometraje excedente del señalado en el contrato de alquiler realizado con el vehículo arrendado. El cargo del mismo se aplicará en base al importe del mismo reflejado en la tarifa reservada. Se cargará 0.25€ por kilómetro extra no contratado.
1.7. Los cargos por la obtención de un duplicado y/o envío de la llave del vehículo arrendado, en los casos de pérdida y/o daño en la misma, así como el traslado del vehículo inmovilizado como consecuencia de lo anterior a la oficina más cercana de alquiler del arrendador. Estos cargos se aplicarán en base al importe de los mismos reflejado en el documento de Relación de Cargos Adicionales.
Asimismo, se aplicará al arrendatario un cargo en concepto de indemnización por inmovilización del vehículo. que será establecido tomando como referencia el certificado sobre el lucro cesante por paralización de vehículo emitido por la Federación Nacional Empresarial de Vehículos de Alquiler con y sin Conductor (FENEVAL) que determine la cuantía diaria de la paralización.
1.8. Los cargos por la reposición en caso de desaparición o pérdida de accesorios del vehículo tales como, p. e., la pareja de triángulos de emergencia, el chaleco reflectante de seguridad y el botiquín de primeros auxilios. Estos cargos se aplicarán en base al importe de los mismos reflejado en el documento de Relación de Cargos Adicionales.
1.9. Los cargos por la reposición de la documentación del vehículo en el caso de desaparición de la misma. Estos gastos se facturarán en base al precio reflejado en el documento de Relación de Cargos Adicionales.
1.10. Los cargos por la limpieza especial del vehículo tras la devolución del mismo en el caso de que éste se entregara en un estado de suciedad tal que precisase la intervención de una empresa especializada. A título enunciativo que no limitativo se consideran estados de suciedad que requieren la intervención de una empresa especializada: vómitos, manchas de tinta, quemaduras de cigarrillo, barro, suciedad provocada por animales, etc. Este cargo se aplicará en base al precio facturado al arrendador por la empresa seleccionada de limpieza especial de vehículos.
1.11. El cargo administrativo por gestión de multas. Dicho cargo se devengará por cada boletín o expediente sancionador instruido por la autoridad competente en relación con el vehículo arrendado y por hechos acaecidos durante la vigencia del arrendamiento. Este cargo se aplicará en base al importe del mismo reflejado en el documento de Relación de Cargos Adicionales. Este cargo podrá hacerse efectivo mediante en el medio de pago proporcionado por el arrendatario. El arrendador, podrá, no obstante, reclamar un coste mayor por tal gestión si acredita cumplidamente dicho mayor coste y su atribuibilidad.
1.12. El cargo administrativo por gestión de expedientes de daños. Dicho cargo se devengará en el caso de que el vehículo presentara daños materiales que se hubiesen producido durante el periodo de alquiler, cualquiera que fuera su grado, de los cuales el arrendatario sea legalmente y contractualmente responsable. En el caso de que el arrendatario hubiese contratado alguna limitación de responsabilidad definida en la estipulación G.2.1 de estas Condiciones Generales, responderá de los daños producidos si quedaran fuera del alcance de dicha cobertura adicional o por el importe de la posible franquicia contratada. El presente cargo se devengará por cada Expediente de daños independiente. Este cargo se aplicará en base al importe del mismo reflejado en el documento de Relación de Cargos Adicionales.
El importe de la foto-peritación. Dicho cargo se devengará en caso de que sea necesaria una peritación del vehículo a través de foto-peritación en relación a un expediente de daños. En el caso de que el arrendatario hubiese contratado alguna limitación de responsabilidad definida en la estipulación G.2.1 de estas Condiciones Generales, le será reclamado dicho cargo si quedaran fuera del alcance de dicha cobertura adicional los daños producidos que motivan dicha foto-peritación.
1.13. En alquileres por periodos superiores a 28 días de alquiler, el importe en concepto de penalización por no devolverse el vehículo en la fecha señalada en el contrato de alquiler o por la superación en más de 100 kilómetros del kilometraje máximo señalado en el contrato de alquiler. Esta penalización se aplicará en base al importe de la misma reflejado en el documento de Relación de Cargos Adicionales.
1.14. El cargo por la reposición y colocación de la rotulación de la publicidad del arrendador en los vehículos de carga en los que ésa haya sido deteriorada o eliminada durante el periodo de alquiler. Este cargo se aplicará en base al importe del mismo reflejado en el documento de Relación de Cargos Adicionales.
1.15. Salvo acuerdo escrito en contrario, el cargo por los costes de devolución a origen de los vehículos que se devuelvan en una sucursal diferente a la de retirada, de conformidad a los precios fijados en el documento de Relación de Cargos Adicionales. Este cargo se facturará en base al importe reflejado en el documento de Relación de Cargos Adicionales, salvo que el arrendatario acredite que el arrendador ha hecho frente a gastos y/o daños de menor valor. El importe del cargo se hará efectivo en el medio de pago proporcionado por el arrendatario. El arrendador podrá reclamar conceptos adicionales o un coste mayor por tal gestión siempre que acredite cumplidamente dicho mayor coste.
1.16 Respecto de vehículos eléctricos e híbridos, en caso de pérdida o deterioro del cable de carga y /o del cable de carga rápida, el arrendatario deberá abonar al arrendador el cargo en concepto de indemnización reflejado en el documento de Relación de Cargos Adicionales. El pago de este importe por parte del arrendatario no impedirá que el arrendador pueda reclamar cualquier otro desperfecto adicional que la pérdida o deterioro del cable de carga hubiera podido provocar.
1.17. El importe por el cargo administrativo en supuestos de incumplimiento del plazo de alquiler acordado.
Dicho cargo se devengará cuando el arrendatario devuelva el vehículo o las llaves del vehículo más tarde del momento acordado en el contrato de arrendamiento sin haber convenido un nuevo plazo de devolución con el arrendador. Su finalidad es compensar las gestiones administrativas que el arrendador ha de llevar a cabo derivadas
de no contar con el vehículo en el momento convenido y también las encaminadas a lograr la devolución de las llaves y del vehículo.
Este cargo se facturará en base al importe reflejado en el documento de Relación de Cargos Adicionales, salvo que el arrendatario acredite que el arrendador ha hecho frente a gastos y/o daños de menor valor. El importe del cargo se hará efectivo en el medio de pago proporcionado por el arrendatario. El arrendador podrá reclamar conceptos adicionales o un coste mayor por tal gestión si acredita cumplidamente dicho mayor coste y su.
1.19. Respecto del cable/adaptador USB que se le facilitará junto con el vehículo, en caso de pérdida o deterioro del cable de dicho cable/adaptador USB, el arrendatario deberá abonar al arrendador el cargo en concepto de compensación reflejado en el documento de Relación de Cargos Adicionales. El pago de este importe por parte del arrendatario no impedirá que el arrendador pueda reclamar cualquier otro desperfecto adicional que la pérdida o deterioro del cable/adaptador USB hubiera podido provocar.
- Vencimientos de pago
2.1. El precio del alquiler reseñado en el contrato de alquiler, así como cualquier cobertura, limitación de responsabilidad, equipamiento adicional, servicios complementarios, impuestos y tasas aplicables vencen y son pagaderos al inicio del alquiler.
2.2. En arrendamientos por periodos superiores a 28 días, los vencimientos se producirán en periodos de 28 días, siempre al inicio de cada periodo.
2.3. En relación a las reservas con tarifa prepago, el precio del alquiler, así como los demás importes convenidos serán pagaderos al realizar la reserva y se cargarán al método de pago válido que el arrendatario comunique en la reserva, el arrendatario hará efectivo dicho importe el día siguiente a la realización de la reserva.
2.4. El arrendatario incurrirá en mora el día siguiente del vencimiento de la obligación de pago correspondiente, sin que sea necesario requerimiento alguno. En caso de mora, el arrendador podrá exigir además de la cantidad adeudada incrementada en tres puntos sobre la base del interés legal del dinero, los gastos incurridos por el mismo en la reclamación de la cantidad adeudada y derivada del contrato realizado.
2.5. El arrendatario autoriza irrevocablemente al arrendador y a su agente de cobros autorizado a deducir de los medios de pago presentados en el momento de la celebración del contrato de alquiler o facilitados posteriormente por el arrendatario de conformidad con la legalidad vigente, todos los importes y cargos derivados del alquiler del vehículo y todos los demás derechos relacionados con el contrato de alquiler, tanto los incluidos en el contrato de alquiler como los que resulten calculables conforme a lo estipulado en el presente condicionado y en la Relación de Cargos Adicionales. El arrendatario deberá conocer al arrendador la correspondiente autorización usando una tarjeta bancaria expedida a su nombre.
- Depósito al inicio del alquiler
3.1 En garantía del cumplimiento de sus obligaciones o responsabilidad, el arrendatario deberá entregar al comienzo del alquiler una cantidad en concepto de depósito de garantía. El importe del depósito de garantía se calcula sumando al precio de alquiler un importe fijo que depende del grupo de vehículos al que pertenezca el vehículo arrendado. A modo de ejemplo, al alquiler de un vehículo de categoría Economic se le aplicará un depósito equivalente al importe del alquiler más 200€.

El grupo de vehículos al que pertenece un concreto vehículo puede determinarse en cualquier momento on-line en https://www.rentacarcostabrava.com o consultarse llamando por teléfono o en cualquier sucursal Rent a Car Costa Brava.
La obligación del depósito de garantía es de aplicación igualmente a los alquileres realizados con tarifas prepago y el arrendatario se obliga a presentar al arrendador la tarjeta de pago con la que realizó la reserva al objeto de formalizar el depósito.
3.2 El arrendador no está obligado a invertir/utilizar el depósito de garantía de forma independiente al resto de sus activos. Dicho depósito de garantía no genera intereses. El arrendador puede estar legitimado a solicitar que el depósito de garantía se prolongue por un período más extenso, tras el inicio del arrendamiento en supuestos de prolongación de la duración del alquiler o de no haber satisfecho el arrendatario el precio y posibles cargos derivados del alquiler.
3.3. El depósito se prestará por el arrendatario a través del método de pago válido que sea aceptado por el arrendador. La caducidad del método de pago válido que se utilice para el depósito deberá ser, al menos, superior a 30 días sobre la fecha de finalización del contrato de arrendamiento.
3.4. El arrendador solicitará antes del inicio del alquiler a la entidad emisora de la tarjeta de pago una autorización por la cantidad que corresponda en concepto de depósito como garantía de obligaciones o responsabilidades de pago a asumir por el arrendatario durante el periodo de alquiler. Esta cantidad estará disponible, a solicitud del arrendador, en el momento de la formalización del contrato de alquiler. De no ser posible realizar dicho depósito, el arrendador podrá denegar el alquiler al arrendatario.
3.5. Tras la devolución del vehículo y habiendo realizado las comprobaciones del vehículo necesarias, la cantidad facturada al arrendatario por el alquiler del vehículo y restantes conceptos según lo indicado en la estipulación E.1 de estas Condiciones Generales, será cargada al método de pago válido facilitado por el arrendatario. Desde ese momento quedará sin efecto alguno la autorización solicitada al inicio de alquiler a la entidad emisora de la tarjeta en concepto de depósito.
- Forma de pago
4.1 Salvo que se convenga otra forma de pago predeterminada por el arrendador, el precio del alquiler, el depósito y todos los demás importes convenidos señalados en la estipulación E.1.1 de estas Condiciones Generales se cargarán al método de pago válido que el arrendatario comunique en el momento de la realización de la reserva prepago o en el momento de la formalización del contrato de alquiler si la reserva no fuera prepago.
El arrendador acepta tarjetas de crédito y débito Visa i MasterCard. No se aceptan tarjetas de prepago como medio de pago. El arrendador no acepta tarjetas Maestro/VPAY, excepto para alquileres de vehículos hasta el Grupo Mediuem (excepto Suv & Premium Cars). La tarjeta debe de estar a nombre de uno de los arrendatarios, debiendo presentarse físicamente dicha tarjeta para poder formalizar el contrato de arrendamiento. Este método de pago válido comunicado al arrendador no podrá ser cambiado por el arrendatario en ningún momento durante la duración del contrato o tras finalizar el mismo. Adicionalmente, la caducidad de la tarjeta de pago que se utilice para el pago deberá ser al menos superior a 30 días sobre la fecha de finalización del contrato de arrendamiento.
4.2. Los cargos por equipamiento adicional o accesorios extraviados o rotos y/o servicios complementarios adicionales que se pongan de manifiesto al finalizar el contrato de alquiler se cargarán a la misma tarjeta de pago. El arrendatario podrá exigir el desglose de los conceptos facturados, pudiendo impugnar los mismos dentro del plazo legalmente establecido.
4.3 Mediante la contratación con el arrendador y la comunicación de los datos de su tarjeta de pago en el momento de la contratación o en un momento posterior, el arrendatario autoriza al arrendador para que impute a la misma los créditos que por el precio de alquiler, depósito y cualesquiera otros costes y responsabilidades mencionados en estas Condiciones Generales, se devenguen en relación con el contrato de alquiler.
- Facturación
5.1 El arrendatario otorga su consentimiento para que el arrendador envíe las facturas al destinatario previamente especificado, en formato electrónico de acuerdo con la legislación vigente, a la dirección de correo electrónica registrada.
5.2 El arrendatario se responsabiliza de asegurarse que las facturas electrónicas puedan llegarle correctamente o, en caso de que así se convenga, de recogerlas en formato electrónico.
5.3 El arrendatario tiene la facultad de oponerse al envío de facturas en formato electrónico en cualquier momento, mediante notificación expresa de dicha oposición. En este caso, el arrendador le remitirá al arrendatario las facturas en papel.
5.4 El arrendador no se hace cargo de posibles interferencias en los sistemas de recepción u otras circunstancias que impidan la correcta recepción de las facturas por parte del arrendatario. Una factura se considera recibida por el arrendatario en cuanto entre en la zona de dominio del mismo. Cuando el arrendador se limita a enviar un aviso y el arrendatario pueda descargar la factura de forma autónoma, o cuando la factura es habilitada para la descarga por parte del arrendador, se considera como recibida en el momento en que la factura haya sido descargada por el arrendatario. El arrendatario se compromete a llevar a cabo descargas puntuales de las facturas habilitadas en intervalos de tiempo razonables.
5.5 Si una factura no llega a su destino o no puede ser recibida, el arrendatario notificará inmediatamente lo ocurrido al arrendador. En este caso, el arrendador remitirá nuevamente una copia de la factura al arrendatario, identificándola como copia. Mientras perdure la avería que obstaculiza el envío de facturas, el arrendador podrá enviar las facturas en papel hasta que no se subsane dicha interferencia.
5.6 En el supuesto de que el arrendador le proporcione datos de acceso, como nombre de usuario o contraseña al arrendatario, éste tendrá que protegerlos ante terceras personas no autorizadas y gestionar dichos datos de forma estrictamente confidencial.
5.7 Si el arrendatario tiene conocimiento de que personas no autorizadas han tenido acceso a la información confidencial, deberá comunicarlo de inmediato al arrendador.
- DEVOLUCIÓN DEL VEHÍCULO
- La duración del alquiler será la pactada inicialmente en el contrato de alquiler y se facturará en base a periodos de 24 horas, contados desde la hora en que éste se hubiera formalizado. El arrendatario se compromete a devolver el vehículo al arrendador junto con las llaves, documentación, accesorios y equipamiento adicional, a más tardar a los 30 minutos convenidos en el contrato de arrendamiento, así como en el lugar pactado en el contrato de alquiler. En caso de no devolverlo así, el arrendatario se obliga a pagar al arrendador los cargos adicionales según lo recogido en la condición E.1.
Se considerará terminado el servicio cuando el vehículo y las llaves del mismo hayan sido recepcionados por el personal del arrendador o depositadas las llaves en los buzones de devolución electrónicos del arrendador instalados a tal efecto.
Salvo acuerdo escrito en contrario, deberá el arrendatario devolver el vehículo dentro del horario de oficina expuesto en cada una de las sucursales del arrendador. En caso de haberse acordado la devolución del vehículo fuera del horario de la oficina el arrendatario ha de estacionar el vehículo en el espacio acordado. Deberá dejar los extras en el maletero del vehículo, los frenos accionados o el vehículo en posición de “aparcamiento” y el vehículo cerrado. Las llaves del vehículo deberán dejarse en el buzón de devolución, junto con la indicación del lugar en que se haya estacionado el vehículo. El arrendatario no deberá nunca entregar las llaves a una persona no autorizada incluso aunque pareciera un empleado. El arrendatario continúa siendo responsable del vehículo hasta que el arrendador localice efectivamente el vehículo. Si el arrendatario acuerda con el arrendador devolver el vehículo “fuera del horario de apertura de la oficina” acepta que el Protocolo de Devolución del Vehículo sea elaborado por el personal del arrendador sin su presencia y tras la devolución de las llaves.
- Los precios de alquiler se calculan según las horas de recogida y devolución especificadas en el contrato. El arrendador siempre ofrece un período de cortesía de 30 minutos. En caso de una devolución tardía del vehículo se facturará el periodo no pactado en el contrato de alquiler conforme a las tarifas vigentes. Las tarifas especiales solamente regirán para los periodos especificados en la oferta. En caso de que se sobrepasara el periodo de cortesía serán de aplicación las tarifas vigentes a toda la duración del contrato de alquiler.
- Si el arrendatario devuelve el vehículo con antelación a la fecha prevista sin avisar de ello al arrendador, el arrendador no tendrá la obligación de aplicar ninguna reducción sobre el precio del alquiler. En este caso, el arrendador cobrará un cargo administrativo de 13,00 EUR (IVA /incl.) por los gastos en los que incurra. Se entenderá que existe devolución anticipada del vehículo cuando el arrendatario devuelve el vehículo antes del día y hora señalados en el contrato. También podría aplicarse un precio estándar más alto si, por ejemplo, ya no se cumplen las condiciones para una tarifa especial. En este caso, sin embargo, no se excederá del precio de alquiler acordado originalmente. En todo caso, el arrendador podrá decidir aplicar un descuento del 50% sobre el importe correspondiente a los días de alquiler no utilizados (periodos de 24 horas). El importe máximo que deberá asumir el cliente por los días de alquiler no utilizados ascenderá al máximo de 181,50 Euros (IVA incl.)
Si el Arrendatario hubiera ya abonado los costes de Alquiler para beneficiarse de la tarifa "prepago -pago por anticipado" no tendrá derecho a reembolso alguno. Esta tarifa de devolución no se aplica a las tarifas de prepago, de acuerdo con la sección D.3 de estos términos y condiciones generales El cargo administrativo por devolución anticipada no se aplica a las reservas con tarifa de prepago.
- Es responsabilidad del arrendatario el garantizar la entrega efectiva del vehículo en el lugar convenido en el contrato de alquiler. La devolución en lugar diferente al pactado por causa no imputable al arrendador dará lugar a la aplicación del cargo administrativo denominado En otra oficina-, según se describe en el apartado E.1. y por el importe indicado en el documento de Relación de Cargos Adicionales.
En el contrato de alquiler se acuerda una determinada sucursal como lugar de devolución del vehículo al finalizar el alquiler.
Si se devolviera el vehículo en una oficina diferente a la designada en el contrato de alquiler como lugar de devolución (bien porque se acordó devolver en la misma oficina de recogida del vehículo o porque, aunque se acordó la devolución en otra oficina, finalmente el arrendatario devuelve el vehículo en una oficina diferente a la acordada en el contrato) además del cargo por En otra oficina el arrendatario debe abonar el cargo de 59€ por gestión de flota.
La devolución del vehículo en lugares no permitidos dará lugar a la aplicación del cargo “Devolución en lugares no permitidos” cuyos importes según el lugar de devolución no permitida se reflejan en el documento de Relación de Cargos Adicionales. No está permitido devolver el vehículo fuera de nuestras oficinas. A nivel internacional no está permitida la devolución en un país distinto.
- El uso de un sistema de navegación en el vehículo durante el período de alquiler puede dar lugar a que se almacenen en el vehículo los datos de navegación. Cuando se enlazan teléfonos móviles u otros dispositivos a un vehículo, los datos de dichos dispositivos podrían también ser almacenados en el vehículo. Rent a Car Costa Brava no recopila ni trata estos datos. Si el arrendatario y/o conductor desea que dichos datos no permanezcan en el vehículo tras su devolución, debe asegurar por sí mismo el borrado de dichos datos antes de devolver el vehículo. El borrado/eliminación de los datos puede efectuarse reseteando el navegador y sistemas de comunicación del vehículo, lo cual se efectuará indicando “configuración de fábrica”. No es responsabilidad del arrendador borrar los datos mencionados.
- La cantidad entregada en concepto de depósito de garantía al inicio del contrato de alquiler por el arrendatario al arrendador no podrá servir para una prolongación de la duración del contrato. El contrato de alquiler podría ser prorrogado por un tiempo superior al pactado, previa autorización por escrito por parte del arrendador, siempre y cuando el arrendatario lo solicite con tres días de antelación a la fecha de finalización del contrato de alquiler. La prolongación podrá realizarse telefónicamente por un plazo de hasta cinco días adicionales una única vez por contrato de alquiler. El arrendatario se compromete a autorizar de inmediato sobre el medio de pago ya proporcionado una garantía adicional a la inicialmente prestada que cubra el período prolongado, siendo el precio aplicable al periodo prolongado del alquiler el correspondiente a la tarifa vigente en dicho momento. Es responsabilidad del arrendatario personarse en las oficinas del arrendador para obtener el nuevo contrato de alquiler con la prolongación correspondiente. El arrendador podrá denegar la prolongación del contrato de alquiler.
- En los alquileres por periodos superiores a 28 días, el arrendatario deberá personarse en las oficinas del arrendador en la fecha que aparece reflejada en su contrato de alquiler para realizar la revisión al vehículo y respetar la limitación de kilometraje máximo señalada en el contrato de alquiler. De no cumplir con esta obligación, el arrendador podrá cargarle el correspondiente cargo reflejado en la estipulación E.1.13 de estas Condiciones Generales.
- En el supuesto de no devolución del vehículo por parte del arrendatario en la fecha prevista y tras dos días de retraso en la devolución sin que se haya extendido el contrato, el arrendador entenderá que existe una apropiación indebida del vehículo procediendo a denunciar dichos hechos ante las autoridades competentes.
- SEGURO DE RESPONSABILIDAD CIVIL OBLIGATORIO / COBERTURAS OPCIONALES Y LIMITACIONES DE RESPONSABILIDAD / SERVICIOS ADICIONALES
G.1.- Seguro de Responsabilidad Civil Obligatorio.
- El vehículo arrendado lleva incluido el seguro de Responsabilidad Civil obligatorio con una cobertura para daños personales y una para daños materiales derivados del uso y circulación del vehículo con las garantías e importes previstos en la legislación vigente, según normativa de la Unión Europea.
- Esta cobertura queda garantizada y es asumida por el asegurador con el que el arrendador tiene concertada la correspondiente póliza de seguro. Mediante la firma del contrato de alquiler el arrendatario se adhiere como asegurado a la mencionada póliza.
- El seguro tiene validez en los países reflejados en el contrato de alquiler.
G.2.- Coberturas Opcionales y Limitaciones de Responsabilidad.
G.2.1. Limitaciones de Responsabilidad.
- a) THIRD PARTY INSURANCE
En caso de que el arrendatario opte por su contratación, la cobertura de responsabilidad THIRD PARTY INSURANCE el arrendatario asume la responsabilidad total por los perjuicios sufridos o los daños causados al vehículo, sus partes o accesorios (incluidos daños a ruedas, cristales, motor, bajos y techo del vehículo) con motivo de accidente de circulación, así como por los perjuicios o daños sufridos por robo, tentativa de robo o vandalismo.
En cuanto a la limitación de responsabilidad, por la no culpabilidad, por los perjuicios sufridos o los daños causados al vehículo, sus partes o accesorios con motivo de accidente de circulación, sólo es aplicable si el arrendatario cumplimenta debidamente la Declaración Amistosa de Accidente, donde deben figurar claramente los datos de los vehículos y conductores implicados en el accidente y las condiciones y circunstancias en las que se produjo el mismo (en particular el lugar, hora y descripción del accidente; nombre, apellidos y dirección de quien conducía durante el accidente).
El arrendatario asume la total responsabilidad por los perjuicios o los daños causados al vehículo, sus partes o accesorios, sufridos por robo, tentativa de robo, o vandalismo.
- B) FULL INSURANCE
En caso de que el arrendatario opte por su contratación, la cobertura FULL INSURANCE exime al arrendatario de responsabilidad (salvo el importe de la franquicia por siniestro convenida en el contrato de alquiler) por los perjuicios sufridos o los daños causados al vehículo, sus partes o accesorios (excluidos motor, bajos y techo del vehículo) con motivo de accidente de circulación, así como por los perjuicios o daños sufridos por robo, tentativa de robo o vandalismo.
En cuanto a la limitación de responsabilidad por los perjuicios sufridos o los daños causados al vehículo, sus partes o accesorios con motivo de accidente de circulación, sólo es aplicable si el arrendatario cumplimenta debidamente la Declaración Amistosa de Accidente, donde deben figurar claramente los datos de los vehículos y conductores implicados en el accidente y las condiciones y circunstancias en las que se produjo el mismo (en particular el lugar, hora y descripción del accidente; nombre, apellidos y dirección de quien conducía durante el accidente). En cuanto a la limitación de responsabilidad por los perjuicios o los daños causados al vehículo, sus partes o accesorios, sufridos por robo, tentativa de robo, o vandalismo, sólo es aplicable si el arrendatario entrega al arrendador el juego de llaves original del vehículo arrendado del que se le hizo entrega en el momento de formalización del contrato de alquiler, sin manipulación alguna, así como el original de la denuncia del incidente presentada ante las autoridades correspondientes.
G.3.- Condiciones de aplicación de las Coberturas de Seguro de Responsabilidad Civil Obligatorio, Coberturas Opcionales y/o Limitaciones opcionales de Responsabilidad. Exclusiones.
Sin perjuicio de lo indicado en los párrafos anteriores y en las presentes Condiciones Generales, la aplicación de las coberturas ofrecidas tanto por el Seguro de Responsabilidad Civil obligatorio, como por las Coberturas Opcionales y/o por las Limitaciones de Responsabilidad se verán sometidas a las siguientes condiciones:
- Se excluyen de la cobertura del seguro, así como de cualquier protección opcional y/o limitativa de responsabilidad contratada, siendo por lo tanto plena responsabilidad del arrendatario, los daños a personas y cosas, y al vehículo que el mismo ocasionara mediando dolo o culpa grave.
- Del mismo modo, quedará excluida la cobertura del seguro, así como la que pudiera proporcionar cualquier protección opcional y/o limitativa de responsabilidad contratada, en los siniestros en los que el conductor del vehículo no fuese un conductor autorizado, o no estuviese en posesión de un permiso de conducción en vigor, o de utilizar el vehículo contraviniendo lo dispuesto en las estipulaciones B.4, B.5, B.6, B.7 y B.8, así como en los supuestos de la estipulación G.2.1. de estas Condiciones Generales.
En general, no quedarán cubiertos por las coberturas contratadas supuestos de daños producidos por un actuar negligente o doloso por parte del arrendatario, tales como el cuidado deficiente del vehículo, su uso inadecuado o ilícito, las distracción o somnolencia durante la conducción, provocar daños al vehículo intencionadamente, ocultar un daño causado al vehículo de manera culposa o realizar un uso negligente del embrague; siendo esta una enumeración descriptiva que no constituye una lista cerrada o numerus clausus de supuestos.
- Las franquicias por siniestro aplicables en función de la protección adicional limitativa de responsabilidad contratada son las vigentes en el momento del alquiler, las cuales se detallan en el concreto contrato de arrendamiento y figuran relacionadas en las tarifas vigentes. 4. El siniestro del vehículo no implica automáticamente una obligación del arrendador de poner a disposición del arrendatario un vehículo de sustitución.

- Quedan excluidos de la limitación de responsabilidad que se contrate los daños que no respondan a un siniestro sino a negligencia, culpa o descuido ocasionados en el interior del vehículo (incluyendo el cable eléctrico de carga y el cable eléctrico de carga rápida de vehículos eléctricos y/o híbridos), en el motor y/o en los bajos o techo del vehículo.
- Todas las coberturas opcionales y limitaciones de responsabilidad resultan de aplicación previa contratación de las mismas por el arrendatario, y son aplicables exclusivamente al arrendatario y a los conductores autorizados por el mismo y previo pago de la suma convenida en el momento de formalizar el contrato de alquiler del vehículo. Su contratación se verá reflejada en el contrato de alquiler. El coste de estas limitaciones de responsabilidad, que son opcionales, así como el importe de las franquicias, podrá consultarse en las tarifas vigentes. La limitación de la responsabilidad contractual solamente tendrá vigencia mientras esté el contrato de arrendamiento vigente.
- El arrendador no responde de los objetos propiedad del arrendatario depositados en el interior del vehículo durante el periodo de alquiler del mismo. Cualquier daño o sustracción de tales objetos será responsabilidad íntegra del arrendatario.
- ACCIDENTES / ROBO/ OBLIGACIÓN DE DENUNCIA
- En caso de accidente, robo, incendio, daños producidos por animales o por efectos de la naturaleza, y en general en cualquier supuesto de daños, deberá el arrendatario o el conductor avisar a la policía o cuerpo de seguridad correspondiente de forma inmediata, así como hacer cuanto sea procedente para proteger los intereses del arrendador. La puesta en conocimiento de la policía de lo sucedido también será preceptiva en caso de accidente por culpa propia y/o sin intervención de terceros y especialmente cuando el vehículo queda inmovilizado o cuando continuar con su conducción significara un peligro para la seguridad del tráfico. En caso de que no sea posible comunicarse con la policía, el arrendatario o el conductor deberán acudir a dar aviso al puesto de policía más cercano. Asimismo, deberá completar un parte descriptivo de accidente (Declaración amistosa), sea responsable o no, y con o sin la implicación de una tercera persona. Ante la comisión de un delito, si hubiera heridos y/o si debiera investigarse la culpabilidad de los implicados, es obligación del arrendatario dar parte inmediato a la policía.
- En caso de accidente con contrario, deberá el arrendatario cumplimentar el parte de Declaración amistosa de accidente en el modelo normalizado que hallará entre la documentación del vehículo y poner en conocimiento por escrito del arrendador inmediatamente, y siempre en un plazo no superior a 24 horas, todos los detalles del accidente, mediante copia del parte, cuyo original entregará en el plazo máximo de dos días. Si el contrario se negase a suscribir un parte de Declaración amistosa, deberá el arrendatario solicitar la presencia y colaboración policial y entregar, igualmente, al arrendador copia del correspondiente atestado.
- La Declaración Amistosa de Accidente se cumplimentará de forma completa y con el máximo grado posible de detalles, tanto respecto de los daños como de las circunstancias en las que los mismos se produjeron. El arrendatario se obliga a firmar y a recoger la firma del contrario, si lo hubiera, en la Declaración Amistosa de Accidente. Si el contrario se negara a firmar, el arrendatario debe solicitar la presencia in situ policial para el esclarecimiento de los hechos, ya que de lo contrario se considerará al arrendatario como responsable del accidente, salvo prueba en contrario aportada por éste.
- El arrendatario o conductor deberán tomar todas las medidas que resulten útiles y convenientes para el esclarecimiento del siniestro. Esto incluye especialmente el deber de responder por completo, y de forma ajustada a la verdad, las preguntas del arrendador relativas a las circunstancias del siniestro y el deber de no abandonar el lugar del accidente antes de que se hayan podido realizar las constataciones necesarias y significativas, en particular, para que el arrendador pueda valorar el siniestro, así como el deber de no impedir que el arrendador pueda realizar dichas constataciones. El arrendatario autoriza al arrendador a solicitar a la autoridad o cuerpo de seguridad de que se trate, una copia del informe del accidente o atestado.
- El siniestro o el robo del vehículo no implica automáticamente una obligación del arrendador de poner a disposición del arrendatario un vehículo de sustitución
- RESPONSABILIDADES
- La responsabilidad del arrendador se extiende a los daños y perjuicios ocasionados por sus empleados y demás personas por las que deba responder según ley, en los supuestos de dolo o negligencia grave, salvo que el arrendador acreditase haber empleado la diligencia del buen padre de familia para evitar los perjuicios. Los daños y perjuicios indemnizables por incumplimiento contractual se extenderán únicamente al daño emergente previsible (inclusive grúas, peritajes, costes legales, etc.) y razonable y en ningún caso a meras expectativas.
- Responderán sin limitación el arrendatario y demás conductores autorizados por la vulneración de cualquier disposición normativa que cometan durante la vigencia del contrato, en especial por infracciones de tráfico. El arrendatario mantendrá indemne al arrendador respecto de cualesquiera sanciones, multas, tasas, recargos, y en general costes de todo tipo que se le impongan por las Administraciones. Serán por cuenta y cargo del arrendatario todos aquellos gastos efectivamente satisfechos por las tareas administrativas que deba de asumir el arrendador con motivo de los requerimientos que las Administraciones le dirijan a fin de esclarecer la autoría o demás circunstancias de una infracción o delito en los términos recogidos en estipulación E.1.11 de estas Condiciones Generales.
- RESOLUCIÓN DEL CONTRATO
- Las partes tendrán derecho a resolver el contrato de concurrir una causa legal para ello. El arrendador tendrá derecho a resolver el contrato con efectos inmediatos, en el caso de que el arrendatario se demore en más de dos días en el pago de cualesquiera importes vencidos o de concurrir otra justa causa.
En este sentido, tendrán la consideración de causa justa:
- La devolución de recibos, cheques o cargos en tarjeta o medio de pago proporcionado, salvo que el arrendatario proceda al pago en el plazo de dos días, o el incumplimiento de las condiciones de pago previamente acordadas con el arrendador.
- En caso de que el arrendatario utilice el vehículo en un modo no adecuado a su destino o cause daños al mismo mediando dolo o negligencia grave, inclusive la falta de mantenimiento o revisiones cuando viniera obligado a ello.
- Vulneración de disposiciones aplicables en materia de transportes;
- Incumplir cualquiera de las prohibiciones incluidas en las estipulaciones B.4, B.5, B.6, B.7 y B.8. de estas Condiciones Generales;
- Y en general, cuando no resulte exigible, atendidas las circunstancias, la continuación de la relación arrendaticia, por ejemplo, en caso de una elevada siniestralidad o superación reiterada del kilometraje máximo.
- En caso de resolución del contrato, vendrá el arrendatario obligado a la inmediata devolución del vehículo, las llaves, la documentación y los accesorios. En todo caso, el arrendador tendrá derecho, al resolver el contrato, a retirar el vehículo de allí donde se hallare.
- En caso de resolución contractual podrá el arrendador reclamar los daños y perjuicios que la misma le haya ocasionado, lo que incluye no solo el daño emergente (inclusive grúas, peritajes, costes legales, etc.) sino también el lucro cesante por la falta de disponibilidad del vehículo (que será establecido tomando como referencia el certificado sobre el lucro cesante por paralización de vehículo emitido por la Federación Nacional Empresarial de Vehículos de Alquiler con y sin Conductor -FENEVAL- que determine la cuantía diaria de la paralización).
- DISPOSICIONES GENERALES
- El arrendatario tiene derecho a recibir un ejemplar en castellano de las presentes Condiciones Generales y así se ha hecho constar en las versiones de las mismas redactadas en otros idiomas. En caso de discrepancias la versión dirimente será la redactada en castellano.
- La compensación de créditos operará de conformidad con la legislación vigente. En este sentido, el depósito de garantía sólo puede ser compensado después de haber comprobado que el arrendatario ha cumplido con todas sus obligaciones, de acuerdo con la estipulación E.3.5 de estas Condiciones Generales.
- En caso de existir más de un arrendatario o conductor, responderán todos solidariamente frente al arrendador.
- Todos los derechos y las obligaciones que se deriven de las presentes condiciones y del contrato serán extensivos a los conductores autorizados.
- MODIFICACIONES
- No existen pactos entre arrendatario y arrendador no reflejados por escrito en el contrato de alquiler o en estas Condiciones Generales. Cualquier modificación de los mismos deberá realizarse por escrito y firmado por ambas partes.

Information on prepaid rates
- Modification of the reservation
Prior to the start of the rental and one hour in advance, modifications may be made for which the tenant will be taxed with an amount corresponding to the modification charge (€ 29.99). The price to be applied after the modification of the reservation will be that of the rate in force at the time of the change. No refund will be made of the amount already paid/prepaid in case of a price difference.
- Cancellation The reservation can be canceled before the start of the rental by post, fax or email. In case of cancellation, the amount paid in advance will be refunded, deducting the cancellation charge that amounts to the first three days of rental, including extras and fees. In case the duration of the reservation is less than three days, no amount will be paid.

Age provisions
In Spain, the following rules govern the minimum age and the possession of a driving licence:

Refueling of the tank
The lessee must return the fuel tank in the same condition in which he received it. If not, we will take care of refueling the deposit of your vehicle after returning it. The refuelling charge shall include both the cost of litres of fuel at the market price that actually need to be refuelled and the refuelling management charge. The charge for refueling management amounts to 32.06 Euros.
The erroneous refueling of the fuel tanks implies an additional charge to the lessee whose amount will vary depending on the damage caused. In leases provided with AdBlue deposit, the lessee is responsible for the maintenance of the sufficiently full tank, responding to the damages caused by the breach of this obligation by paying an additional charge whose amount will vary depending on the damage caused.
Administrative charge for managing fines
The standard charge for the management of each sanctioning file instructed by the competent authority during the rental period of the vehicle will be EUR 39.00.
Administrative fee for management of damage files / Photo-appraisal fee
Except for the exceptions regulated in clause E.1.12 of the General Rental Conditions, the amount of the administrative charge for the management of damage files amounts to EUR 44.77 for damage. In case of management of damage files that have been declared as total loss, the administrative charge for file management will amount to EUR 100,43. The amount of the charge for photo-appraisal of the damage caused amounts to EUR 16,94.
Penalty for non-return of vehicles in long-term rentals
In rentals from 28 days of rental, if the vehicle is not returned on the date indicated in the rental contract or for exceeding by more than 100 kilometers the maximum mileage indicated in the rental contract, the penalty amounts to 605.00 EUR for each contravention.
Charge for delivery of replacement vehicle during the lease in case of negligence of the lessee
In case the lessee needs a replacement vehicle during the duration of the rental period signed in the contract, whatever it may be, he will proceed to pay EUR 309.00 as long as the need for this vehicle is caused by negligence of the lessee and especially in case of erroneous refueling and loss of vehicle key. Additionally, there could be associated crane charges that would be claimed by the Damage Department and would amount to EUR 1.20 per kilometer of travel from the place where the vehicle is located to the nearest office of Grup Fauria or the nearest concerted workshop of Grup Fauria in Catalonia.
Roadside assistance charge
If the roadside assistance is motivated by a mechanical failure not attributable to a negligent act on the part of the lessee, regardless of the contracting or not of coverage according to clause G of the General Rental Conditions, the lessee will not assume any cost for the roadside assistance service.
The lessee will be billed a charge for roadside assistance in the event of a breakdown in wheels and / or glass if he has not contracted in FULL INSURANCE and it is necessary to tow the vehicle.
In breakdowns not related to wheels and / or glass, the lessee will be charged for roadside assistance as long as he has not contracted the coverage of reduction of excess limitation or FULL INSURANCE and the vehicle will need to be towed.
The cost of the roadside assistance towing charge amounts to EUR 1,20 per kilometre travelled, up to a maximum amount of EUR 500, as applicable, or you have made prohibited or negligent use of the vehicle.
When the fault is solved "on site", without the need to tow the vehicle, the service charge amounts to EUR 40.

Purposes of processing
Your identity and driving licence are verified within the Rent a Car Costa Brava system through a photo identification process or by one of our employees. For this purpose, we process your master data, contract data (driving license data and photo). The copy of your driving licence will be deleted after 36 months. Purposes of processing
We process your master, contact, contractual, financial data and any other data that you have voluntarily provided us to facilitate the completion and execution of the lease.
In addition, we use master, contact and contractual data for customer relationship purposes, e.g. to manage complaints or changes to the booking you have requested from us.
We also use your master and contract data for the purpose of reconciling accounting entries (commissions and processing sales) with, for example, travel agencies, agents, franchisees and other cooperation partners. GENERAL CONDITIONS OF CONTRACTING THE RENTAL OF VEHICLES
These General Conditions regulate the contractual relationship between Fauria Grup SHS S.L, ("the lessor") and the client
("the lessee"), by virtue of which the former assigns to the latter the use of a vehicle for the term, price and other
conditions established in the rental contract.
A. APPLICABLE LEGAL REGULATION
1.These General Contracting Conditions are subject to the provisions of Royal Legislative Decree 1/2007, of November
16, which approves the Revised Text of the General Law for the defense of consumers and users and other
complementary laws, modified by Law 3/2014, of March 27; to Law 44/2006, of 29 December, on improving the
protection of consumers and users, to the regional regulations in force in the place of provision of the service, as well as
to any other regulations that replace, complement or modify the above, in what may be applicable.
2. The lessee is obliged to comply with the General Rental Conditions of the country of provision of the service.
B. USE OF THE VEHICLE
1. The lessee undertakes to use and drive the vehicle in compliance with the rules of the Highway Code in force at the
place and at the time of provision of the service and in accordance with the specifications of use of the type of vehicle
leased.
2. It is mandatory that the tenant always carries with him his copy of the rental contract in force during the duration of
the same.
3.- In case of use of the vehicle for the transport of minors of height equal to or less than 135 centimeters, the lessee
must provide child restraint systems adapted to each age group and place them in the vehicle in accordance with current
traffic regulations. The lessee must also check the adequacy, use and placement in the vehicle of the child restraint
systems. The lessor assumes no responsibility for the lack of use, installation, checking, incorrect use of the mandatory
restraint device.
4. The vehicle may only be used on public roads.
It is expressly forbidden:
a) Driving the vehicle on unauthorized or unpaved roads, or whose condition could pose a risk to the safety and integrity
of the vehicle or a risk of damage to it;
b) Participate with the vehicle in races, speed and / or endurance tests, contests or challenges of any nature;
c) Use the vehicle for driving practices;
(d) Use the vehicle for strength testing of automotive materials, accessories or products;
(e) Use the vehicle in the event of a risk of damage to the vehicle, in particular use of the vehicle after the light indicators
in the instrument cluster have been illuminated;
(f) Transporting persons for consideration;
(g) Committing criminal acts with the vehicle, even if such act is only considered criminal at the place of commission;
h) Driving the vehicle with decreased physical conditions, motivated by alcohol, drugs, fatigue or illness;
(i) Use the vehicle to push or tow other vehicles or any other object;
j) Transport in the vehicle toxic, flammable and generally dangerous substances and / or that violate the legal provisions
in force;k) Transport the vehicle on board any type of ship, train, truck or aircraft, unless expressly authorized in writing by the
lessor;
l) Circulate inside the enclosures of ports, airports, aerodromes and / or similar of a nature not accessible to public traffic,
as well as in enclosures or facilities of refineries and oil companies, unless expressly authorized in writing by the lessor.
5. The lessee must take care that the load of the vehicle is correctly distributed and placed safely and always respecting
the limits of weight, quantity and / or volume authorized and indicated in the Registration Certificate and / or the
Technical Inspection Sheet of the Vehicle. Likewise, the lessee is responsible for ensuring that the number of occupants
of the vehicle is not higher than that authorized and indicated in the Registration Certificate and / or the Technical
Inspection Sheet of the Vehicle.
6. It is forbidden for the lessee to assign, sublease, rent, mortgage, pledge, sell, encumber or in any way give as a
guarantee both the vehicle and the rental contract, the keys thereto, the documentation, equipment, tools and / or
accessories thereof and / or any other part or piece thereof; or treat the foregoing in a manner that causes harm to the
landlord.
7. Below you will find information regarding the countries to which the leased vehicle is not allowed to travel, as well as
the countries for which certain vehicle models are not rented. The choice of a vehicle category or brand may restrict entry
into certain countries. In order to describe these entry restrictions, the countries are divided into three zones.
Zone 1: Spain
Zone 2: Andorra, France
Zone 3: All countries not included in zone 1 or zone 2.
Vehicles considered Premium Cars may not leave Spain unless expressly authorized in writing by the lessor.
Vehicles of all other brands may enter zones 1 and 2 only.
Entry is generally not allowed in zone 3 countries.
The group to which a vehicle belongs can be consulted at any time online www.rentacarcostabrava.com, as well as by
phone or at any Rent a Car Costa Brava office.
In leases made in Spain, the movement of the vehicle from the peninsula to any island and vice versa and / or between
islands, as well as to Ceuta and Melilla, is expressly prohibited, all unless expressly authorized in writing by the lessor.
The rental agreement also contains this information.
It is the obligation of the lessee to check the specific traffic regulations of the countries to which he plans to travel and
assume the responsibilities derived from the non-compliance with them. The lessee must check whether in the countries
to which he intends to travel it is mandatory to use certain tyres, or the payment of traffic fees or specific tolls for driving
on certain special roads and satisfy these fees or tolls.
8. Cross-border travel: the Customer is authorized to drive the rented vehicle within Spain. Section B.7 of these general
conditions establishes the countries to which it is not possible to move the vehicle. The displacement of the vehicle
outside of Spain has the character of a cross-border trip and requires the payment of an additional fee. The amount of
this fee can be consulted in the document annexed to these conditions called List of additional charges. Failure to comply
with the prohibition of moving the vehicle to certain countries, due to fault or negligence, is subject to a penalty of € 150,
which has the character of a contractual penalty. Fauria Grup SHS S.L could also claim compensation for damages higher
than the previous amount by crediting greater damages. In such cases, the claim for the contractual penalty shall be
offset by any claim for additional compensation for damages arising from that same breach of obligations.
9. At the time of formalization of the rental contract, the lessee and any other person designated in the lease as a driver
must be present and present valid driving licenses valid and valid in the country of rental, as well as their corresponding
valid personal identification documents. The lessor reserves the express right to refuse the rental of the vehicle in the
event that the lessee or any other person designated in the lease as a driver does not duly prove his identity or be the
holder of a valid and valid driving license at the time of formalizing the rental contract. Driving licenses will not be
accepted in digital or electronic format unless the applicable regulations expressly allow it.
The vehicle may only be driven by the lessee, as well as by those persons designated in the lease as driver, provided that
they are over 21 and 25 years old respectively depending on the category of the vehicle to be leased and whose driving
licenses have the required age depending on the group of vehicle to be leased as specified in the additional Charges
relationship document. Regarding drivers under 23 years of age, specific charges will be applied, the amounts of which
are available in the Additional Charges List document.
The following are considered valid driving licences in Spain:
a) Those issued in accordance with the Spanish legislation in force;
b) Those issued by the member states of the European Union in accordance with Community regulations;
c) Those issued by other countries that were recognized as valid for the purpose of allowing driving in Spain according to
the regulations of the General Directorate of Spanish Traffic.
d) Valid international permit, which will be provided together with the valid national permit of the corresponding country
for the purpose of allowing driving in Spain according to the regulations of the General Directorate of Spanish Traffic.
10. Without prejudice to the liability of the lessee towards third parties, if any of the obligations provided for in this
stipulation B are breached or if any of the circumstances provided for in stipulations B.4, B.5, B.6, B.7, B.8 and B.9 are
met, the lessor may terminate the contract with immediate effect, as well as claim compensation for damages, including
loss of profits, which the breach in question has caused to him.
Similarly, in the event of breaches of essential obligations by the lessor, the lessee may terminate the rental contract in
advance before the initially agreed period elapses, in accordance with the provisions of current legislation and these
general conditions.
C. CONDITION OF THE VEHICLE
1. The lessor will deliver and the lessee will receive the vehicle described in the contract in correct condition of operation,
maintenance and sheet metal, without deficiencies, except for the observations that may be made when receiving the
vehicle in the rental contract itself. In the event that any deficiency not included in the rental contract is found in the
leased vehicle, it will be the lessee's obligation to notify the lessor's office in which the rental contract has been made
and the vehicle is delivered, before moving the vehicle from the parking space in which the vehicle specified in the
contract is parked, in order to incorporate these data into the rental contract that will be delivered back to the lessee.
2. The lessee will receive the vehicle described in the contract with the complete documentation, as well as with the
vehicle key, tools and accessories, especially reflective vests and signaling triangles, which must be checked by the lessee
at the time of delivery of the vehicle at the beginning of the lease, notifying any deficiency in the office where he rented
the vehicle. The lessee undertakes to use the accessories diligently and to return them in the same condition in which
they were delivered. In the case of non-return of the accessories at the end of the rental contract, the lessee must pay
the lessor the value of the accessories not delivered, based on the charge for compensation of the same reflected in the
document of Relationship of Additional Charges. It is the responsibility of the lessee at all times to close the vehicle
correctly when leaving it.
3. In the event that during the rental of the vehicle any of the luminous indicators that detect an anomaly of operation
of the vehicle that affects the safety and integrity of the vehicle is illuminated in the instrument panel or when it perceives
external signs indicating breakdown or malfunction of the same, the lessee must stop the vehicle as soon as possible and
contact the lessor or the roadside assistance company arranged by the landlord. Using the vehicle in case of risk is
prohibited. Charges will only be accepted from roadside assistance companies not arranged by the lessor in cases of
urgency, and must come from official workshops of the vehicle brand and prior express written authorization from the
lessor. Likewise, manipulating the kilometer count of the vehicle is totally prohibited, and the lessee must immediately
notify the lessor of any breakdown in it.
Depending on the coverage contracted by the lessee in stipulation G of these General Conditions, a charge for roadside
assistance may be applied, as specified in the Additional Charges List document. Only in cases of mechanical failure not
attributable to negligent action on the part of the lessee, regardless of the contracting or not of coverage according to
stipulation G of these General Conditions, the lessee will not assume any charge for the roadside assistance service.
Always and in any case, the lessee must respond if he has made a prohibited use of the vehicle, as stated in stipulation
B.4 of these General Conditions, as well as in case of negligence.
4. The lessee must comply with the warnings of liquid and oil levels, as well as regularly review them and, in general,
allow the performance of safety inspections or revisions that are appropriate and in accordance with the specifications
of use of the type of vehicle. These revisions must be carried out by the workshops authorized by the lessor, otherwise
the lessee will be liable for any damage arising from the incorrect replacement of the fluid levels of the engine of the
leased vehicle.
The lessee undertakes to treat and keep the vehicle with care and diligence, to respect all applicable standards and
technical rules and to periodically check if the vehicle is in good working order, as well as to close it correctly. Smoking is
prohibited in the rental vehicle.
5. In the case of leases of vehicles equipped with an AdBlue ® tank, the lessee must verify that the tank is always
sufficiently full, responding to the damages caused by the breach of this obligation. The lessee must immediately notify
the lessor in case of turning on the luminous pilot of the instrument panel that indicates the need to fill the AdBlue tank,
and must follow the instructions that are given at that time by the lessor. In the event that the lessee does not follow the
instructions given by the lessor and as a result damage to the vehicle originates, the lessee will be responsible for them.
6. Vehicles with combustion engines (including hybrid vehicles) shall be delivered to the lessee with the fuel tank at the
level indicated in the contract on the same day that he collects the vehicle, the latter being obliged to return it in the same
condition in which he received it. In the event that the lessee does not return the vehicle with the fuel tank agreed in the
initial contract, an additional charge will be applied that includes both the cost of fuel and the charge for refueling
management, reflected in the Additional Charges List document. This charge may be made by charging the Security
Depository or the valid payment method with which the payment of the lease has been guaranteed. No amount will be
refunded for the possible fuel that may remain in the tank.
The lessee must refuel the vehicle with the type of fuel suitable for it, otherwise the lessee will be responsible for the
expenses incurred by the transfer and / or repair of the damage caused to the vehicle as a result. Likewise, in this case, the
lessee must pay the lessor a charge for loss of profits for the days of immobilization of the vehicle, which will be established
taking as a reference the certificate on the loss of profit due to vehicle stoppage issued by the National Business Federation
of Rental Vehicles with and without Driver (FENEVAL) that determines the daily amount of the stoppage.
8. The lessee receives the vehicle with all its tires in good condition and without punctures, together with a spare tire (or
failing that a repair kit) In vehicles equipped with the run flat tire system (type of tires that allows them to roll without air
for a certain number of kilometers) the vehicle can be received without a spare tire or repair kit. In case of deterioration
and / or loss of any of the tires (for reasons other than normal wear, poor assembly or manufacturing defect) the lessee
undertakes to inform the lessor. The repairs and / or replacements of tires must be carried out by the workshops authorized
by the lessor, otherwise the lessee will be responsible for any damage arising from the incorrect replacement of the same.
9. It is forbidden for the lessee to vary any technical characteristic of the vehicle, as well as to make any modification of
its exterior and / or interior appearance (unless express written authorization by the lessor). In case of violation of this
stipulation, the lessee must pay the lessor the costs, duly justified, of reconditioning the vehicle to its original state and pay
the lessor a charge as compensation for loss of profits for the days of immobilization of the vehicle, which will be
established taking as a reference the certificate on the loss of profit due to vehicle stoppage issued by FENEVAL (National
Business Federation of Rental Vehicles with and without Driver) that determines the daily amount of the stoppage.
It is forbidden for the lessee to repair the vehicle by himself or by third parties, unless expressly authorized by the lessor.
10. With the prior written authorization of the lessor, in cases where, due to the net weight of the vehicle and the possibility
of attaching a trailer to it, a supplement to the road tax should be paid, the lessee must carry out the corresponding
procedures and satisfy it, with complete indemnity of the lessor for any fee, tax, surcharge, penalty or cost that will be
imposed for breaching the applicable regulations. The leased vehicle must be returned to the lessor in the same condition
in which it was received.
D. RESERVATIONS
1. Vehicle reservations refer to categories of vehicles. The reservation in a category does not confer the right to the lessee
to the assignment of a specific model within it.
2. The lessor will keep the reservation of the vehicle until sixty minutes after the agreed time, not being obliged to provide
the service under the agreed conditions after that period.
Cancellations must be made at least 24 hours before the start of the rental.
3. In relation to reservations with prepaid rate, the following will apply
a) Up to one hour before the start of the rental, modifications may be made, in which case a modification charge will
be applied to the lessee as specified in the Additional Charges Relationship document, in addition to the
difference between the rate initially selected and the rate to which it has been changed.
b) The price to be applied after the modification of the reservation will be that of the rate in force at the time of the
change. The lessor will not make any refund of the advance of the rental price already paid / paid in advance, nor
of the possible difference in rate in the event of a price difference arising after the modification made.
c) You can cancel the prepaid reservation prior to the start of the rental at least 24 hours in advance. In case of
cancellation, the lessor will reimburse the lessee the advance of the rental price already paid or paid in advance,
retaining the cancellation fee that amounts to the price of the first three days of rental (price calculated in
accordance with the provisions of stipulation E of these General Conditions, including additional equipment and
complementary services). In the event that the duration of the reservation is less than three days, no amount will
be refunded as there is no right of withdrawal with respect to the vehicle rental activity.
d) Cancellations can be made online (www.rentacarcostabrava.com/) or in writing by postal mail (by letter to Fauria
Grup SHS S.L. Avinguda Vidreres nº 3. Lloret de Mar (17310) Girona.
E. RENTAL CHARGES / MATURITIES / SECURITY DEPOSIT / PAYMENT METHOD
1. The lessee undertakes to pay the lessor:
1.1 The rental charges outlined in the rental agreement corresponding to duration (minimum rental charge of 24 hours),
coverages, limitations of liability, additional equipment and complementary services, according to the stipulated
conditions, as well as the applicable taxes and fees.
These will be billed based on the rates in force at the time of booking. In case of not having booked previously and / or
unless a bonus or special price has been agreed, the rental charges related to the rates in force at the time of making the
rental contract will apply.
1.2. The charges derived from the non-return of the rented vehicle in the same correct state of operation, maintenance
and sheet metal as you received it at the time of rental. The lessee is liable to the lessor for any damage that occurred to
the vehicle during the rental period, for the partial or total theft of the same and for the damages derived from
contractual breaches, except for the limitations of responsibilities and optional coverages that he has contracted (see
stipulation G.2.1 of these General Conditions), in addition to what results from applying the legal provisions in force in
what is not regulated in these General Conditions.
If the limitations of liability contained in stipulation G.2.1 of these General Conditions are contracted and a claim occurs,
these limitations will not apply in the cases listed below, responding in these cases the lessee in full for the damages
caused:
a) Damages caused by himself or by those persons for whom he must respond, when there is intent or gross
negligence;
b) In cases where the lessee does not deliver the descriptive part of the accident and / or part of the friendly
declaration or does so late or incompletely, or records false facts and data in them;
c) In case of omission of the duty of help or by the omission of the obligation to obtain the police presence provided
for in clause H, unless such damages had been caused without intent or gross negligence of the lessee;
d) In the event that the cause of the damage is an unauthorized driver;
e) In the event of contravening the prohibitions of stipulations B.4, B.5, B.6, B.7 and B.8 of these General
Conditions.
The repair charges for which the lessee must respond shall be calculated by the independent and official expert for this
purpose selected by the lessor or by another expert chosen by common agreement of the parties. The amount thus
determined – where appropriate, the amount of the franchise – will be claimed from the lessee together with the
administrative charge for the management of damage files and the amount of the photo-appraisal, the amounts of which
are reflected in the Additional Charges List document. The tenant has the right to receive a copy of the appraisal. In the
event that the cost cannot be determined in this way, it will be fixed by the budget of the repair shop. The amount of
compensation paid by the lessee for total loss will be the market value prior to the expert examination of the vehicle at
the event. The lessor is entitled to claim the consequential damage (including cranes, expert reports, legal costs, etc.)
and the loss of profits due to the unavailability of the vehicle.
1.3. Charges for contracting additional equipment after the rental contract has been formalized and requested during
the duration of the same. These will be invoiced based on the Additional Charges List document at the time of contracting
them and must appear in the new rental contract signed by the lessee.
Charges for contracting services or complementary optional coverages after the rental contract has been formalized and
requested during the duration of it. These will be invoiced based on the price in force at the time of contracting and must
appear in the new rental contract signed by the lessee. Once the vehicle keys have been handed over, additional optional
coverages can only be added within 15 minutes of the signature of the initial lease agreement.
1.4. The fuel not refueled in the rented vehicle at the time of return of the same, as well as the costs of refueling service
of said fuel, as stipulated in stipulation C.6 of these General Conditions. The fuel charge will be billed based on the current
market price and the refueling service charge based on the amount reflected in the Additional Charges List document.
1.5. Charges for transfer and / or repair of damage to the vehicle caused by improper use of fuel in an incorrect refueling,
as stipulated in stipulation C.6 of these General Conditions.
1.6. The excess mileage indicated in the rental contract made with the leased vehicle. The charge of the same will be
applied based on the amount of the same reflected in the reserved rate. 0.15€ will be charged per extra kilometer not
contracted.
1.7. The charges for obtaining a duplicate and / or sending the key of the leased vehicle, in cases of loss and / or damage
to it, as well as the transfer of the immobilized vehicle as a result of the above to the nearest rental office of the lessor.
These charges will be applied based on the amount of the same reflected in the Additional Charges List document.
Likewise, a charge will be applied to the lessee as compensation for immobilization of the vehicle. that will be established
taking as a reference the certificate on the loss of profits due to vehicle stoppage issued by the National Business
Federation of Rental Vehicles with and without Driver (FENEVAL) that determines the daily amount of the stoppage.
1.8. Charges for replacement in case of disappearance or loss of vehicle accessories such as, e.g., the pair of emergency
triangles, the reflective safety vest and the first aid kit. These charges will be applied based on the amount of the same
reflected in the Additional Charges List document.
1.9. Charges for the replacement of the vehicle documentation in the event of its disappearance. These expenses will be
invoiced based on the price reflected in the Additional Charges List document.
1.10. Charges for the special cleaning of the vehicle after the return of the same in the event that it is delivered in a state
of dirt such that it requires the intervention of a specialized company. By way of example, but not limited to, states of
dirt that require the intervention of a specialized company are considered: vomiting, ink stains, cigarette burns, mud, dirt
caused by animals, etc. This charge will be applied based on the price invoiced to the lessor by the selected company of
special cleaning of vehicles.
1.11. The administrative charge for managing fines. This charge will accrue for each bulletin or sanctioning file instructed
by the competent authority in relation to the rented vehicle and for events that occurred during the term of the lease.
This charge will be applied based on the amount of the same reflected in the Additional Charges List document. This
charge may be made effective by means of the means of payment provided by the lessee. The lessor may, however, claim
a higher cost for such management if it fully proves said higher cost and its attribubility.
1.12. The administrative charge for the management of damage files. This charge will accrue in the event that the vehicle
presents material damages that have occurred during the rental period, whatever its degree, for which the lessee is
legally and contractually responsible. In the event that the lessee has contracted any limitation of liability defined in
stipulation G.2.1 of these General Conditions, he will be liable for the damages caused if they were outside the scope of
said additional coverage or for the amount of the possible franchise contracted. This charge will accrue for each
independent Damage Record. This charge will be applied based on the amount of the same reflected in the Additional
Charges List document.
The amount of the photo-appraisal. This charge will accrue in the event that an appraisal of the vehicle is necessary
through photo-expertise in relation to a damage file. In the event that the lessee has contracted any limitation of liability
defined in stipulation G.2.1 of these General Conditions, this charge will be claimed if the damages caused by said photoexpertise are outside the scope of said additional coverage.
1.13. In rentals for periods exceeding 28 days of rental, the amount as a penalty for not returning the vehicle on the date
indicated in the rental contract or for exceeding by more than 100 kilometers the maximum mileage indicated in the
rental contract. This penalty will be applied based on the amount of the same reflected in the Additional Charges List
document.
1.14. The charge for the replacement and placement of the labeling of the advertising of the lessor in the cargo vehicles
in which it has been deteriorated or eliminated during the rental period. This charge will be applied based on the amount
of the same reflected in the Additional Charges List document.
1.15. Unless otherwise agreed in writing, the charge for the costs of returning to origin the vehicles that are returned to
a branch other than the one of withdrawal, in accordance with the prices set out in the Additional Charges List
document. This charge will be invoiced based on the amount reflected in the Additional Charges List document, unless
the lessee proves that the lessor has incurred expenses and / or damages of lesser value. The amount of the charge will
be made effective in the means of payment provided by the lessee. The lessor may claim additional concepts or a higher
cost for such management provided that it fully proves that this higher cost is met.
1.16 With respect to electric and hybrid vehicles, in case of loss or deterioration of the charging cable and/or the fast
charging cable, the lessee must pay the lessor the compensation charge reflected in the Additional Charges Statement
document. The payment of this amount by the lessee will not prevent the lessor from claiming any other additional damage
that the loss or deterioration of the charging cable could have caused.
1.17. The amount for the administrative charge in cases of non-compliance with the agreed rental period.
This charge will accrue when the lessee returns the vehicle or the keys to the vehicle later than the time agreed in the
lease without having agreed a new return period with the lessor. Its purpose is to compensate the administrative
procedures that the lessor has to carry out derived
of not having the vehicle at the agreed time and also those aimed at achieving the return of the keys and the vehicle.
This charge will be invoiced based on the amount reflected in the Additional Charges List document, unless the lessee
proves that the lessor has incurred expenses and / or damages of lesser value. The amount of the charge will be made
effective in the means of payment provided by the lessee. The lessor may claim additional concepts or a higher cost for
such management if it fully proves said higher cost and its.
1.19. With respect to the USB cable/adapter that will be provided with the vehicle, in case of loss or deterioration of the
cable of said USB cable/adapter, the lessee must pay the lessor the charge for compensation reflected in the Additional
Charges Statement document. The payment of this amount by the lessee will not prevent the lessor from claiming any
other additional damage that the loss or deterioration of the USB cable / adapter could have caused.
2. Payment due dates
2.1. The rental price outlined in the rental agreement, as well as any coverage, limitation of liability, additional equipment,
complementary services, applicable taxes and fees are due and payable at the beginning of the rental.
2.2. In leases for periods longer than 28 days, maturities will occur in periods of 28 days, always at the beginning of each
period.
2.3. In relation to reservations with a prepaid rate, the rental price, as well as the other amounts agreed upon will be
payable when making the reservation and will be charged to the valid payment method that the lessee communicates in
the reservation, the lessee will make this amount effective the day after the reservation is made.
2.4. The lessee will be in arrears on the day following the expiration of the corresponding payment obligation, without
any requirement being necessary. In case of default, the lessor may demand in addition to the amount owed increased
by three points on the basis of the legal interest of the money, the expenses incurred by the same in the claim of the
amount owed and derived from the contract made.
2.5. The lessee irrevocably authorises the lessor and his authorised collection agent to deduct from the means of payment
presented at the time of the conclusion of the rental agreement or subsequently provided by the lessee in accordance
with the legislation in force, all amounts and charges arising from the rental of the vehicle and all other rights related to
the rental agreement, both those included in the rental agreement and those that are calculable in accordance with the
provisions of this condition and in the List of Additional Charges. The lessee must inform the lessor of the corresponding
authorization using a bank card issued in his name.
3. Deposit at the beginning of the rental
3.1 In order to guarantee the fulfillment of his obligations or responsibility, the lessee must deliver at the beginning of
the rental an amount as a security deposit. The amount of the security deposit is calculated by adding to the rental price
a fixed amount that depends on the group of vehicles to which the leased vehicle belongs. As an example, the rental of
an Economy category vehicle will be charged a deposit equivalent to the amount of the rental plus € 200.
The group of vehicles to which a particular vehicle belongs can be determined at any time online in https://www.
rentacarcostabrava.com or consult by calling or at any Rent a Car Costa Brava branch.
The obligation of the security deposit also applies to rentals made with prepaid rates and the lessee undertakes to present
to the lessor the payment card with which he made the reservation in order to formalize the deposit.
3.2 The lessor is not obliged to invest/use the security deposit independently of the rest of its assets. This security deposit
does not generate interest. The lessor may be entitled to request that the security deposit be extended for a longer
period, after the start of the lease in cases of extension of the duration of the rental or if the lessee has not satisfied the
price and possible charges derived from the rental.
3.3. The deposit will be lent by the lessee through the valid payment method that is accepted by the lessor. The expiration
of the valid payment method used for the deposit must be at least 30 days after the end date of the lease.
3.4. The lessor will request before the start of the rental from the issuing entity of the payment card an authorization for
the corresponding amount as a deposit as a guarantee of obligations or payment responsibilities to be assumed by the lessee
during the rental period. This amount will be available, at the request of the lessor, at the time of formalization of the rental
contract. If it is not possible to make such a deposit, the lessor may deny the rent to the lessee.
3.5. After the return of the vehicle and having carried out the necessary vehicle checks, the amount invoiced to the lessee
for the rental of the vehicle and other concepts as indicated in stipulation E.1 of these General Conditions, will be charged
to the valid payment method provided by the lessee. From that moment on, the authorization requested at the beginning
of the rental to the card issuer as a deposit will be null and void.
4. Payment method
4.1 Unless another form of payment predetermined by the lessor is agreed, the rental price, the deposit and all other
agreed amounts indicated in stipulation E.1.1 of these General Conditions will be charged to the valid payment method
that the lessee communicates at the time of making the prepaid reservation or at the time of the formalization of the
rental contract if the reservation was not prepaid.
The landlord accepts Visa i MasterCard credit and debit cards. Prepaid cards are not accepted as a means of payment.
The lessor does not accept Maestro/VPAY cards, except for car rentals up to the Mediuem Group (except Suv & Premium
Cars). The card must be in the name of one of the tenants, and the card must be physically presented in order to formalize
the lease. This valid payment method communicated to the lessor may not be changed by the lessee at any time during
the duration of the contract or after its termination. Additionally, the expiration of the payment card used for payment
must be at least 30 days after the end date of the lease.
4.2. Charges for additional equipment or lost or broken accessories and/or additional complementary services that
become apparent at the end of the rental contract will be charged to the same payment card. The lessee may demand
the breakdown of the invoiced items, being able to challenge them within the legally established period.
4.3 By contracting with the lessor and communicating the data of his payment card at the time of contracting or at a later
time, the lessee authorizes the lessor to impute to it the credits that for the rental price, deposit and any other costs and
responsibilities mentioned in these General Conditions, accrue in connection with the rental agreement.
5. Invoicing
5.1 The Lessee gives his consent for the Lessor to send the invoices to the previously specified recipient, in electronic
format in accordance with current legislation, to the registered email address.
5.2 The Lessee is responsible for ensuring that electronic invoices can reach him correctly or, if so agreed, for collecting
them in electronic format.
5.3 The lessee has the right to oppose the sending of invoices in electronic format at any time, by express notification of
such opposition. In this case, the landlord will send the tenant the paper invoices.
5.4 The Lessor is not responsible for possible interference with the reception systems or other circumstances that prevent
the correct receipt of invoices by the Lessee. An invoice is considered received by the lessee as soon as he enters the area
of ownership of the same. When the lessor merely sends a notice and the lessee can download the invoice autonomously,
or when the invoice is enabled for download by the lessor, it is considered as received at the time the invoice has been
downloaded by the lessee. The lessee undertakes to carry out punctual downloads of the enabled invoices in reasonable
intervals of time.
5.5 If an invoice does not reach its destination or cannot be received, the lessee will immediately notify the lessor of what
happened. In this case, the landlord will again send a copy of the invoice to the lessee, identifying it as a copy. As long as
the breakdown that hinders the sending of invoices persists, the lessor may send the invoices on paper until such
interference is remedied.
5.6 In the event that the lessor provides access data, such as username or password to the lessee, the latter will have to
protect them from unauthorized third parties and manage such data in a strictly confidential manner.
5.7 If the Renter becomes aware that unauthorized persons have had access to the confidential information, he/she must
immediately notify the Lessor.
F. RETURN OF THE VEHICLE
1. The duration of the rental will be the one initially agreed in the rental contract and will be invoiced based on periods
of 24 hours, counted from the time it was formalized. The lessee undertakes to return the vehicle to the lessor together
with the keys, documentation, accessories and additional equipment, no later than the 30 minutes agreed in the lease,
as well as in the place agreed in the rental contract. In case of not returning it like this, the lessee undertakes to pay the
lessor the additional charges as set out in condition E.1.
The service will be considered terminated when the vehicle and the keys to it have been received by the lessor's staff or
the keys deposited in the electronic return mailboxes of the lessor installed for this purpose.
Unless otherwise agreed in writing, the lessee must return the vehicle within the office hours set forth in each of the
lessor's branches. If the return of the vehicle has been agreed outside office hours, the lessee must park the vehicle in
the agreed space. You must leave the extras in the trunk of the vehicle, the brakes activated or the vehicle in a "parking"
position and the vehicle closed. The vehicle keys must be left in the return mailbox, together with the indication of the
place where the vehicle was parked. The tenant must never hand over the keys to an unauthorized person even if he or
she appears to be an employee. The renter remains responsible for the vehicle until the lessor effectively locates the
vehicle. If the lessee agrees with the lessor to return the vehicle "outside the opening hours of the office" he accepts that
the Vehicle Return Protocol will be prepared by the lessor's staff without his presence and after the return of the keys.
2. Rental prices are calculated according to the pick-up and drop-off times specified in the contract. The landlord always
offers a courtesy period of 30 minutes. In case of a late return of the vehicle, the period not agreed in the rental contract
will be invoiced according to the current rates. Special rates will only apply for the periods specified in the offer. In the
event that the courtesy period is exceeded, the rates in force will apply to the entire duration of the rental contract.
3. If the lessee returns the vehicle in advance of the scheduled date without notifying the lessor, the lessor shall not be
obliged to apply any reduction on the rental price. In this case, the lessor will charge an administrative fee of 13.00 EUR
(VAT / incl.) for the expenses incurred. It will be understood that there is an early return of the vehicle when the lessee
returns the vehicle before the day and time indicated in the contract. A higher standard price may also apply if, for
example, the conditions for a special rate are no longer met. In this case, however, it will not exceed the originally agreed
rental price. In any case, the lessor may decide to apply a 50% discount on the amount corresponding to the unused
rental days (24-hour periods). The maximum amount to be assumed by the customer for unused rental days will amount
to a maximum of 181.50 Euros (VAT incl.)
If the Lessee has already paid the Rental costs to benefit from the "prepaid -prepayment" rate, he will not be entitled to
any refund. This return fee does not apply to prepaid fees, in accordance with section D.3 of these general terms and
conditions The administrative charge for early return does not apply to reservations with prepaid rate.
4. It is the responsibility of the lessee to guarantee the effective delivery of the vehicle in the place agreed in the rental
contract. The return in a place other than the one agreed for reasons not attributable to the lessor will result in the
application of the administrative charge called In another office-, as described in section E.1. and for the amount indicated
in the document of Relationship of Additional Charges.
In the rental contract, a certain branch is agreed as the place of return of the vehicle at the end of the rental.
If the vehicle is returned to an office other than the one designated in the rental contract as the place of return (either
because it was agreed to return at the same office of collection of the vehicle or because, although the return was agreed
in another office, finally the lessee returns the vehicle in an office different from the one agreed in the contract) in
addition to the charge for In another office the lessee must pay the charge of € 59 by fleet management.
The return of the vehicle in places not allowed will result in the application of the charge "Return in places not allowed"
whose amounts according to the place of return not allowed are reflected in the document of Relationship of Additional
Charges. It is not allowed to return the vehicle outside our offices. At the international level, the return in a different
country is not allowed.
5. The use of an in-vehicle navigation system during the rental period may result in navigation data being stored in the
vehicle. When mobile phones or other devices are linked to a vehicle, data from those devices may also be stored in the
vehicle. Rent a Car Costa Brava does not collect or process this data. If the lessee and/or driver wishes that such data does
not remain in the vehicle after its return, he must ensure for himself the erasure of said data before returning the vehicle.
The deletion/deletion of the data can be done by resetting the navigator and communication systems of the vehicle, which
will be done indicating "factory settings". It is not the responsibility of the landlord to delete the aforementioned data.
6. The amount paid as a security deposit at the beginning of the rental agreement by the lessee to the lessor may not be
used for an extension of the duration of the contract. The rental contract could be extended for a longer time than agreed,
with prior written authorization from the lessor, as long as the tenant requests it three days before the end date of the
rental contract. The extension may be made by telephone for a period of up to five additional days once per rental
contract. The lessee undertakes to immediately authorize on the means of payment already provided an additional
guarantee to the one initially provided that covers the extended period, being the price applicable to the extended period
of the rental the one corresponding to the rate in force at that time. It is the responsibility of the tenant to appear at the
landlord's offices to obtain the new rental contract with the corresponding extension. The landlord may refuse to extend
the rental agreement.7. In rentals for periods longer than 28 days, the lessee must appear at the lessor's offices on the date reflected in his
rental contract to carry out the review of the vehicle and respect the maximum mileage limitation indicated in the rental
contract. If you do not comply with this obligation, the lessor may charge you the corresponding charge reflected in
stipulation E.1.13 of these General Conditions.
8. In the event of non-return of the vehicle by the lessee on the scheduled date and after two days of delay in the return
without the contract having been extended, the lessor will understand that there is a misappropriation of the vehicle
proceeding to report these facts to the competent authorities.
G. MANDATORY LIABILITY INSURANCE / OPTIONAL COVERAGES AND LIMITATIONS OF LIABILITY / ADDITIONAL
SERVICES
G.1.- Compulsory Civil Liability Insurance.
1. The rented vehicle includes the compulsory Civil Liability insurance with a coverage for personal injuries and one for
material damage derived from the use and circulation of the vehicle with the guarantees and amounts provided for in
current legislation, according to European Union regulations.
2. This coverage is guaranteed and is assumed by the insurer with which the lessor has agreed the corresponding
insurance policy. By signing the rental contract, the lessee adheres as an insured to the aforementioned policy.
3. The insurance is valid in the countries reflected in the rental agreement.
G.2.- Optional Coverages and Limitations of Liability.
G.2.1. Limitations of Liability.
a) THIRD PARTY INSURANCE
In the event that the lessee opts for its contracting, the liability coverage THIRD PARTY INSURANCE the lessee assumes
full responsibility for the damages suffered or damage caused to the vehicle, its parts or accessories (including damage
to wheels, glass, engine, underbody and roof of the vehicle) due to a traffic accident, as well as for the damages or damages
suffered by theft, attempted theft or vandalism.
As for the limitation of liability, for non-fault, for damages suffered or damage caused to the vehicle, its parts or
accessories due to a traffic accident, it is only applicable if the lessee duly completes the Friendly Accident Declaration,
which must clearly include the data of the vehicles and drivers involved in the accident and the conditions and
circumstances in which it occurred (in particular the place, time and description of the accident; name, surname and
address of the driver during the accident).
The lessee assumes full responsibility for damages or damages caused to the vehicle, its parts or accessories, suffered by
theft, attempted theft, or vandalism.
B) FULL INSURANCE
In the event that the lessee opts for his contract, the FULL INSURANCE coverage exempts the lessee from
liability (except for the amount of the excess for loss agreed in the rental contract) for the damages suffered
or the damages caused to the vehicle, its parts or accessories (excluding engine, underbody and roof of the
vehicle) due to a traffic accident, as well as for damages or damages suffered by theft, attempted theft or
vandalism.
As for the limitation of liability for damages suffered or damage caused to the vehicle, its parts or accessories
due to a traffic accident, it is only applicable if the lessee duly completes the Friendly Declaration of Accident,
which must clearly include the data of the vehicles and drivers involved in the accident and the conditions and
circumstances in which it occurred (in particular the place, time and description of the accident; name,
surname and address of the driver during the accident). As for the limitation of liability for damages or
damages caused to the vehicle, its parts or accessories, suffered by theft, attempted theft, or vandalism, it is
only applicable if the lessee delivers to the lessor the original set of keys of the leased vehicle of which it was
delivered at the time of formalization of the rental contract, without any manipulation, as well as the original
of the incident report filed with the corresponding authorities.
G.3.- Conditions of application of the Compulsory Civil Liability Insurance Coverages, Optional Coverages
and / or Optional Limitations of Liability. Exclusions.
Without prejudice to what is indicated in the previous paragraphs and in these General Conditions, the
application of the coverages offered both by the compulsory Civil Liability Insurance, as well as by the Optional
Coverages and / or by the Limitations of Liability will be subject to the following conditions:
1. They are excluded from the insurance coverage, as well as from any optional and / or limiting protection of
contracted liability, being therefore full responsibility of the lessee, the damages to people and things, and to
the vehicle that it causes through intent or serious fault.
2. In the same way, insurance coverage, as well as that which could provide any optional and/or limiting
protection of contracted liability, in claims in which the driver of the vehicle was not an authorized driver, or
was not in possession of a valid driving license, or to use the vehicle in contravention of the provisions of
stipulations B.4, shall be excluded, B.5, B.6, B.7 and B.8, as well as in the cases of stipulation G.2.1. of these
General Conditions.
In general, they will not be covered by the contracted coverages cases of damages caused by a negligent or
intentional act on the part of the lessee, such as the deficient care of the vehicle, its improper or illicit use,
distraction or drowsiness while driving, causing damage to the vehicle intentionally, concealing damage
caused to the vehicle in a culpable manner or making a negligent use of the clutch; this being a descriptive
enumeration that does not constitute a closed list or numerus clausus of assumptions.
3. The excesses for claims applicable based on the additional protection limiting liability contracted are those
in force at the time of rental, which are detailed in the specific lease agreement and are related in the current
rates. 4. The loss of the vehicle does not automatically imply an obligation on the lessor to make a replacement
vehicle available to the lessee.

5. Excluded from the limitation of liability are damages that do not respond to an accident but to negligence,
fault or carelessness caused inside the vehicle (including the electric charging cable and the electric cable for
fast charging of electric and / or hybrid vehicles), in the engine and / or in the underside or roof of the vehicle.
6. All optional coverages and limitations of liability are applicable after contracting them by the lessee, and
are applicable exclusively to the lessee and the drivers authorized by the same and upon payment of the
amount agreed at the time of formalizing the rental contract of the vehicle. Your hiring will be reflected in the
rental agreement. The cost of these limitations of liability, which are optional, as well as the amount of the
excesses, can be consulted in the current rates . The limitation of contractual liability will only be effective as
long as the lease is in force.
7. The lessor is not responsible for the objects owned by the lessee deposited inside the vehicle during the
rental period of the same. Any damage or theft of such objects will be the full responsibility of the lessee.
H. ACCIDENTS / THEFT / REPORTING OBLIGATION
1. In case of accident, theft, fire, damage caused by animals or by effects of nature, and in general in any case
of damage, the lessee or the driver must notify the corresponding police or security body immediately, as well
as do everything appropriate to protect the interests of the lessor. The informing of the police of what
happened will also be mandatory in case of accident due to their own fault and / or without the intervention
of third parties and especially when the vehicle is immobilized or when continuing with its driving would mean
a danger to traffic safety. In case it is not possible to communicate with the police, the tenant or the driver
must go to give notice to the nearest police station. Likewise, you must complete a descriptive report of
accident (Friendly Declaration), whether responsible or not, and with or without the involvement of a third
party. In the event of the commission of a crime, if there are injuries and/or if the guilt of those involved should
be investigated, it is the tenant's obligation to give immediate notice to the police.
2. In the event of an accident with the contrary, the lessee must complete the part of the Friendly Declaration
of Accident in the standard model that will be found among the documentation of the vehicle and inform the
lessor in writing immediately, and always within a period not exceeding 24 hours, all the details of the accident,
by means of a copy of the part, whose original will be delivered within a maximum period of two days. If the
contrary refuses to sign a part of the Friendly Declaration, the lessee must request the presence and
collaboration of the police and also deliver to the lessor a copy of the corresponding attestation.
3. The Friendly Declaration of Accident shall be completed in full and with the maximum possible degree of
detail, both with respect to the damage and the circumstances in which it occurred. The lessee undertakes to
sign and collect the signature of the opponent, if any, in the Friendly Declaration of Accident. If the contrary
refuses to sign, the lessee must request the presence in situ police for the clarification of the facts, since
otherwise the lessee will be considered responsible for the accident, unless proof to the contrary provided by
him.
4. The lessee or driver must take all the measures that are useful and convenient for the clarification of the
accident. This includes in particular the duty to answer fully, and in a manner consistent with the truth, the
landlord's questions concerning the circumstances of the accident and the duty not to leave the scene of the
accident before the necessary and significant findings have been made, in particular so that the lessor can
assess the claim, as well as the duty not to prevent the lessor from making such findings. The lessee authorizes
the landlord to request from the authority or security body in question, a copy of the accident report or
attestation.
5. The loss or theft of the vehicle does not automatically imply an obligation on the lessor to make a
replacement vehicle available to the lessee
I. RESPONSIBILITIES
1. The liability of the lessor extends to the damages caused by its employees and other persons for whom it
must respond according to law, in the cases of intent or gross negligence, unless the lessor proves to have
used the diligence of the good father of the family to avoid the damages. Damages compensable for breach
of contract shall extend only to foreseeable (including cranes, expertise, legal costs, etc.) and reasonable and
in no case to mere expectations.
2. The lessee and other authorized drivers will respond without limitation for the violation of any regulatory
provision they commit during the term of the contract, especially for traffic infractions. The lessee shall hold
the lessor harmless with respect to any penalties, fines, fees, surcharges, and in general costs of all kinds
imposed by the Administrations. All expenses effectively satisfied by the administrative tasks that the lessor
must assume due to the requirements that the Administrations direct to him in order to clarify the authorship
or other circumstances of an infraction or crime in the terms contained in stipulation E.1.11 of these General
Conditions will be borne and at the expense of the lessee.
J. TERMINATION OF THE CONTRACT
1. The parties shall have the right to terminate the contract if there is a legal cause for doing so. The lessor
shall have the right to terminate the contract with immediate effect, in the event that the lessee is delayed by
more than two days in the payment of any amounts due or if another just cause concurs.
In this sense, the following shall be considered just cause:
- The return of receipts, checks or charges on card or means of payment provided, unless the lessee proceeds
to payment within two days, or failure to comply with the payment conditions previously agreed with the
lessor.
- In the event that the lessee uses the vehicle in a way that is not appropriate to its destination or causes
damage to it through intent or gross negligence, including lack of maintenance or revisions when forced to do
so.
- Violation of applicable provisions on transport;
- Failure to comply with any of the prohibitions included in stipulations B.4, B.5, B.6, B.7 and B.8. of these
General Conditions;
- And in general, when it is not required, taking into account the circumstances, the continuation of the lease
relationship, for example, in case of a high accident rate or repeated exceedance of the maximum mileage.
2. In case of termination of the contract, the lessee will be obliged to immediately return the vehicle, the keys,
the documentation and the accessories. In any case, the lessor will have the right, when terminating the
contract, to remove the vehicle from where it is located.
3. In the event of contractual termination, the lessor may claim the damages that it has caused, which includes
not only the consequential damage (including cranes, expert reports, legal costs, etc.) but also the loss of profit
due to the lack of availability of the vehicle (which will be established taking as a reference the certificate on
the loss of profit due to vehicle stoppage issued by the National Business Federation of Rental Vehicles with
and without Driver -FENEVAL- to determine the daily amount of the stoppage).
K. GENERAL PROVISIONS
1. The lessee has the right to receive a copy in Spanish of these General Conditions and this has been stated
in the versions of the same written in other languages. In case of discrepancies, the directing version will be
the one written in Spanish.
2. The clearing of claims shall operate in accordance with the legislation in force. In this sense, the security
deposit can only be compensated after having verified that the lessee has fulfilled all his obligations, in
accordance with stipulation E.3.5 of these General Conditions.
3. If there is more than one lessee or driver, they shall all be jointly and severally liable to the lessor.
4. All rights and obligations arising from these conditions and the contract shall extend to authorised drivers.
L. MODIFICATIONS
1. There are no agreements between tenant and lessor not reflected in writing in the rental contract or in
these General Conditions. Any modification thereof must be made in writing and signed by both parties.
